CHAPTER 8.04

ADOPTION OF STATE LAWS

8.04.01            Adoption of state laws

8.04.01 Adoption of state laws The "Uniform Act Regulating Traffic on Highways of Arkansas", as contained in Title 27 of the Arkansas Statutes, three (3) copies of which

are on file in the office of the Mayor, is hereby adopted as traffic rules and regulations within and for the city. Any person convicted of violation of said statutes shall be deemed guilty of the violation of the ordinances of the city, and shall be fined or imprisoned or both in the manner set out under the state statutes.

            8.08.01 Adopted The full size Master Street Plan Map displayed at City Hall along with the attached Master Street Plan, be and are hereby adopted as the Master Street Plan and the Master Street Plan Map for the city of Johnson, Arkansas, in the place and stead of the previous Master Street Plan, Master Street Plan Map and the revised Master Street Plan Map. (Ord. No. 2010-1, Sec. 1.)

            8.08.02 Roads and streets The street/road types depicted on the attached Master Street Plan and the full size Master Street Plan Map displayed at City Hall are hereby adopted for roads and streets in the city of Johnson, Arkansas. (Ord. No. 2010-1, Sec. 2.)

            8.08.03 Uses and occupations All uses and occupation of lands within the city shall be in accordance with the described uses as set forth in the Master Street Plan and on the full size Master Street Plan Map displayed at City Hall and no structures or improvements shall hereafter be permitted or allowed which encroach on the streets/roads in the Master Street Plan as attached or as depicted on the full size Master Street Plan Map displayed at City Hall. (Ord. No. 2010-1, Sec. 3.)

            8.08.04 Fine Disobedience to the provisions of the Master Street Plan as indicated by the Master Street Plan and the full size Master Street Plan Map displayed at City Hall in regard to the use and occupation of specific parcels of land within the city or encroachment on depicted roads/streets shall be punished as provided in the Johnson ordinances. (Ord. No. 2010-1, Sec. 4.)

 

CHAPTER 8.12

TRUCK ROUTES

            8.12.01 Streets designated Hewitt Street, McGuire Street and Ball Street be, and said streets are hereby designated as the North-South truck route in the city of Johnson; Main Street East and West from the east corporate limits west to the Railroad right-of-way and Van Asche Street from Gregg Street to McGuire Street is hereby designated as the East-West truck route in the city of Johnson. (Ord. No. 139, Sec. 1.)

            8.12.02 Weight limits The city of Johnson shall erect signs giving notice that no person shall drive, nor move, nor cause to be driven or moved as through traffic a vehicle or vehicles of a size or weight exceeding ten thousand (10,000) pounds gross over or upon the public residential streets situate in the city of Johnson, Arkansas, except those streets designated as truck routes in 8.12.01 of this ordinance, provided however, that the provisions of this ordinance shall not apply to fire or police vehicles or apparatus. (Ord. No. 139, Sec. 2.)

            8.12.03 Fine Any person, individual, firm or corporation violating the terms of this ordinance shall be fined in a sum not less than Twenty-Five Dollars ($25.00) nor more than One Hundred Dollars ($100.00), and each day’s violation shall be and constitute a separate offense. (Ord. No. 139, Sec. 3.)

            8.12.04 Additional truck routes The following identified streets or portions of streets are hereby designated as truck routes within the city of Johnson, Arkansas; Joyce Street from the east city limits to its intersection within Wilkerson Street; Wilkerson Street from the north end of the Clear Creek Bridge south along Wilkerson Street to the south city limits; Greathouse Springs Road from the center of the north/south lanes of I-540 west along Greathouse Springs Road to a point one quarter mile (1320 feet) from the said beginning point. (Ord. No. 2000-9, Sec. 1.)

 

CHAPTER 8.16

DRIVING

            8.16.01            Careless driving

            8.16.02            Fine

            8.16.01 Careless driving It shall be unlawful for any person to operate a motor vehicle in disregard for the safety of persons and property, and any person operating a vehicle in such manner shall be guilty of a violation of this ordinance. (Ord. No. 78, Sec. 1.)

            8.16.02 Fine Any person convicted of violation of this ordinance shall be fined not more than Two Hundred Dollars ($200.00). (Ord. No. 78, Sec. 2.)

            8.20.02 Roads and streets The multi-use trails depicted on the attached Master Trail Plan and the full size Master Trail Plan Map displayed at City Hall are hereby adopted for trails in the city of Johnson, Arkansas. (Ord. No. 2008-2, Sec. 2.)

            8.20.03 Uses and occupations All uses and occupation of lands within the city shall be in accordance with the described uses as set forth in the Master Trail Plan and on the full size Master Trail Plan Map displayed at City Hall and no structures or improvements shall hereafter be permitted or allowed which encroach on the multi-use trails in the Master Trail Plan as attached or as depicted on the full size Master Trail Plan Map displayed at City Hall. (Ord. No. 2008-2, Sec. 3.)

            8.20.04 Fine Disobedience to the provisions of the Master Trail Plan as indicated by the Master Trail Plan and the full size Master Trail Plan Map displayed at City Hall in regard to the use and occupation of specific parcels of land within the city or encroachment on depicted multi-use trails shall be punished as provided in the Johnson ordinances. CHAPTER 8.24

MOVING BUILDINGS

            8.24.01 Permit Hereafter no person, firm or corporation shall move any building on, through or over any street, alley, sidewalk or other public place in the city of Johnson, Arkansas, without having obtained a permit therefor from the Building Inspector. Application for such permit shall be in writing and directed to the Recorder/Treasurer and shall state thereon the name and address of the applicant, the point from which the proposed move will commence, the proposed tract or tracts of land upon which said buildings will be located, the assessed valuation of the building, type of construction of said building, that the structure has been approved by the Building Inspector, proposed route and the number of days it is intended that the building shall occupy any portion of any street, alley, sidewalk or other public place. (Ord. No. 26, Sec. 1.)

            8.24.02 Fee Upon approval of the intended route by the Building Inspector, a fee of Fifteen Dollars ($15.00) for each day or fraction thereof that the building or structure shall occupy any such portion of any street, alley, sidewalk or other public place, shall be paid to the Building Inspector and the permit issued. An additional payment of Fifteen Dollars ($15.00) for each day or fraction thereof over and above the time stated on the permit which any building shall occupy, such street, alley, sidewalk or other public place shall be paid. (Ord. No. 26, Sec. 2.)

            8.24.03 Regulations As a condition to the granting of such a permit, every person, firm or corporation applying for a permit under this ordinance shall submit with his application a cash bond or other bond with a lawful surety or sureties in an amount not less than Five Thousand Dollars ($5,000.00) to be approved by the Building Inspector conditioned on such person, firm or corporation compliance with the provisions of this ordinance and agreeing to pay and holding the city harmless or any claim which may be made against it by reason of the occupation of any street, alley, sidewalk or other public place by the building or structure moved and to insure the protection of the city against damages to its streets resulting from the moving of buildings or structures thereon. (Ord. No. 26, Sec. 3.)

            8.24.04 Warning signs Whenever a street or alley is blocked by a house or structure which is being moved, warning to that effect shall be placed by the Police Department so as to warn vehicles and persons from entering that portion of the street or alley so blocked. The person, firm or corporation moving any building through the streets at night shall keep warning signs and amber lanterns or lights on the building or structure so as to guard against any person or vehicle colliding with said building or structure. (Ord. No. 26, Sec. 4.)

            8.24.05 Wires and cables Whenever it shall be necessary to interfere with wires or cables of a public utility in moving a building, the terms of any special or franchise ordinance governing it shall apply and the bond therein specified shall be given in addition to the bond to insure the protection of the city against damages. If no such terms apply, then the Building Inspector shall determine the expense of repairing the wires and the bond to be given to cover such expense. (Ord. No. 26, Sec. 5.)

            8.24.06 Fine Any person, firm or corporation violating any of the provisions of this ordinance shall be fined no less than Twenty-Five Dollars ($25.00) and no more than One Hundred Dollars ($100.00) for each offense, and a separate offense shall be deemed committed for each day or portion of day during on or which a violation occurs or continues. (Ord. No. 26, Sec. 6.)
