RESOLUTION 2005-4

A RESOLUTION REQUESTING THE FAYETTEVILLE CITY COUNCIL TO
APPROVE FAYETTEVILLE PUBLIC SEWER SERVICE FOR 31.96 ACRES OF
INDISTRIAL PROPERTY ADJOINING SOUTH BALL STREET IMMEDIATELY
NORTH OF THE ARKHOLA CONCRETE PLANT IN THE CITY OF JOHNSON
WHEREAS, the Johnson City Council has rezoned to Industrial 31.96 acres of
real property adjoining South Ball Street immediately north of the Arkhola concrete plant
and more particularly described in Exhibit "A" attached hereto and made a part hereof;
and,
WHEREAS, the developer of said property proposes to install warehouses with an
office which are designed for businesses in the building industry, such as plumbing
contractors and electrical contractors; and,
WHEREAS, the City of Johnson does not currently provide public sewer service;
and,
WHEREAS, without public sewer the aforesaid property would have to be
developed using septic tanks; and,
WHEREAS, a City of Fayetteville public sewer line of adequate size to serve said
property is located within reasonable proximity to the property; and,
WHEREAS, in order to safeguard the environment, the developer of said
property desires public sewer service and is willing to pay the additional cost for public
sewer service to said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Johnson, Arkansas:

SECTION 1. The Johnson City Council hereby requests the Fayetteville City
Council to approve Fayetteville public sewer service to the real property described in
Exhibit "A" attached hereto and made a part hereof.
