RESOLUTION 2010-5

A RESOLUTION AUTHORIZING THE CITY ATTORNEY,
MAYOR AND RECORDER-TREASURER TO SETTLE A
PENDING LAWSUIT BROUGHT BY POWELL
EMERGENCY SERVICES, LLC
WHEREAS, the contractor hired to remove storm debris from the City filed suit against
the City in May of 2009.
WHEREAS, the City received FEMA's reimbursement in June of 2009 and payment of
$88,500.00 was made at that time.
WHEREAS, that the lawsuit seeks additional funds for the cleanup and debris removal in
Heritage Hills and Clear Creek areas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF JOHNSON, ARKANSAS, that:
Based upon estimates of the City Attorney in regard to trial preparation costs and
attendant expenses of trial and the recommendation of the Mayor, Recorder-Treasurer and City
Attorney that said officials are hereby authorized to settle the aforesaid litigation with Powell
Emergency Services, LLC, for the amount of $10,000.00 and payment of said sum from the
General Fund is specifically authorized.
