RESOLUTION 2011-3

A RESOLUTION MEMORIALIZING THE SUPPORT OF THE
CITY OF JOHNSON FOR THE GREENWAY TRAIL SYSTEM
OF NWA AND ACCEPTING RESPONSIBILITY FOR
MAINTENANCE AND UPKEEP FOR THOSE PORTIONS
WITHIN JOHNSON UPON COMPLETION AND TRANSFER
TO THE CITY.
Whereas, several Johnson residents have invested many hours of their time and even
some of their personal funds in bringing into existence a trail system within the City of Johnson
to be used and enjoyed by many in years to come.
WHEREAS, private and government funding will provide resources to actually design
and construct those portions of the trail within Johnson.
WHEREAS, Johnson Clear Creek Trails, a not for profit Arkansas corporation has been
active in acquiring the necessary easements for the trail and will upon completion of trail
construction, transfer those easements to the City of Johnson for permanent maintenance and
upkeep.
BE IT RESOLVED BY THE CITY COUNCIL OF JOHNSON, ARKANSAS, That,
Section 1: The City of Johnson agrees to accept the transfer of land and/or easements
from Johnson Clear Creek Trails, a not for profit Arkansas corporation upon completion of the
various sections and portions of the trail within Johnson.
Upon such transfer, the City of Johnson accepts responsibility for upkeep and
maintenance of those trail sections within the City and agrees to cooperate with neighboring
cities as necessary to ensure a continuous system of trails linking NWA.
Section 2: The City of Johnson commits its resources in the form of the Johnson
Police Department, the fire services/emergency response services, and the street and
maintenance department to the trail system sections within the City.
Section 3: At the appropriate time, the City Council will allocate, by budget, funds to
carry out the intent and commitment of this Resolution,.
