Mayor Lonnie Barron called the council meeting to order at 6:00 PM.
Present were Aldermen Bill Burnett, Buddy Curry, Tom Bramlett, Bob Fantand Clay Dodson. Also present were Chief of
Police Vernon Sisemore, City Attorney Danny Wright, Street Superintendent Randy Birchfield and Recorder/Treasurer
Jennifer Allen. Alderman Melissia Tomiinson was absent.
Mayor Barron thanked everyone for their prayers and concern during his recent illness.
Mayor Barron asked for a motion to approve the minutes of the June 12, 2007 council meeting. Bob Fantmadea
motion to approve the minutes as written and Buddy Curry seconded. All approved.
Monthly Report of Department Heads:
Police Chief Vernon Sisemore stated the PD had one unattended death and they were waiting information from the
crime lab. Chief Sisemore stated he had sent out bids for selling the old police units and the high bid was $5,000.00
from Watts, OK Automotive and asked the council's permission to sell 5 units. Chief Sisemore stated that 2 of the 5
new units were ready to go. Motion to approve the sale of 5 old units was made by Bob Fantand seconded by Clay
Dodson. All approved. Chief Sisemore stated there were some businesses and individuals in town that would like to
make donations to the police department and he asked the council how he should handle it. City Attorney Danny
Wright stated that receipted records must be kept and R/T Jennifer Allen would coordinate control. Bob Fant asked
that City Attorney Wright put the proper procedures for this in writing for the next meeting. Bob Fant made a motion to
approve allowing donations and Buddy Curry seconded. All approved. Chief Sisemore asked if the Act 988 account
could be changed to an interest bearing account and City Attorney Wright stated yes with control of the
Recorder/Treasurer.
Asst. Fire Chief Herb Beitel stated the Johnson Area Volunteer Fire Department had answered 132 calls this year, up
12% from last year. Beitel stated he was going to Little Reckon Friday to complete his class to become a Certified
State Fire Marshal. Mayor Barron stated the grant writer has submitted 2 grants for the JAVFD, and he met with
Congressman Boozman's rep to get help to secure them. Mayor Barron stated it would be late 2007 or early 2008 to
get a yes or no on the grants and if the answer is no they will be filed again immediately.
Street Superintendent Randy Birchfield stated he had hired a new part time employee, Kyle Pennington, to work 5
hours a day. Birchfield recognized Ed Bockenstedtand thanked him for all he had done to help create the parkin the
Saddlebrook subdivision. Birchfield stated the park had been named "Ed Bockenstedt Park" in his honor and
presented the new sign.
Recorder/Treasurer Jennifer Allen stated the medical insurance rates had come down for the last half of the year.
City Attorney Danny Wright stated the city was off the black list with Cingular regarding a ten year old bill and an appeal
would be finished this month on an old battery case.
Mayor Barron stated EW! was progressing on the street by Dollar General and drainage was in and working well. Mayor
Barren stated the Parkhill Clinic expansion has been started at the hospital. Mayor Barren stated the apartments built
by the Elders on main Drive are approaching completion; landscape and fencing are in, but they have work to do on
their drainage. Mayor Barren stated he and City Attorney Wright were working on getting 48^ St. open and hope to
have a report at the next meeting. Mayor Barren stated that the city's traffic signal maintenance agreement with
Springdale ends on Augusts, 2007 and we are looking for someone qualified to take care of that for us.

Mayor Barren presented ORDINANCE 2007-06: AN ORDINANCE CONCERNING GRADING, EROSION CONTROL, AND
STORM WATER POLUTION PREVENTION, PROVIDING FOR THE EMERGENCY CLAUSE AND FOR OTHER PURPOSES. Tom
Bramlett made a motion to read the ordinance by title only and was seconded by Bob Fant. Roll call: Bill Burnett, yes;
Buddy Curry, yes; Tom Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. Mayor Barren stated this ordinance had been
written by EDA and the Planning Commission recommended its passing by the council. City Attorney Danny Wright read
the ordinance by title only. Mayor Barron asked for a motion to approve this first reading by title only. Tom Bramlett
made a motion to accept this first reading and Bob Fant seconded. Roll call: Bill Burnett, yes; Buddy Curry, yes; Tom
Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. Mayor Barron asked for a motion to suspend the rules and continue on
to the second reading by title only. Buddy Curry made a motion to suspend the rules and continue on to the second

Mayor Barron asked for a motion to approve the emergency clause. Bob Fant made a motion to approve the

Fant, yes; Clay Dodson, yes. ORDINANCE 2007-06 was approved and goes into effect immediately.
Mayor Barron presented ORDINANCE 2007-07: AN ORDINANCE ESTABLISHING MINIMUM SPECIFICATIONS AND
REQUIREMENTS FOR STORM WATER RUNOFF WITHIN THE CITY LIMITS OF JOHNSON, ARKANSAS AND AMENDING THE
CITY CODE, PROVIDING FOR THE EMERGENCY CLAUSE AND FOR OTHER PURPOSES. Buddy Curry made a motion to
read the Ordinance by title only and was seconded by Clay Dodson. Roll call: Bill Burnett, yes; Buddy Curry, yes; Tom
Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. City Attorney Danny Wright read the ordinance by title only. Mayor
Barron asked for a motion to approve this first reading by title only. Bob Fant made a motion to accept this first

Dodson, yes. ORDINANCE 2007-07 was approved and will go into effect immediately.
Mayor Barren stated Tracy Hoskins of Paradigm Development had requested an appeal of the Planning Commission's
decision on Petition 2007-11. Hoskins stated the PC voted to approve the preliminary plat of the large scale
development he plans to build north of Joyce Blvd. and east of Wilkerson with the condition of leaving the private drive
open. Hoskins stated his appeal was of this condition because that intersection will become a hazard as the
population of the development increases. Buddy Curry spoke for the PC stating they wanted the street left open so
there would be 2 entrances/exits and the people who live up there would not have to drive around to get out.
Discussion was had. Attorney Jim Crouch, representing Patrick Burton (owner of the Farmer's Ins. Agency on the corner)
stated he believed Burton had a prescriptive right to keep the access to his business open. Two residents on the street
stated they wanted the street left open. Hoskins stated he was not closing streets, just rerouting the access. Richard
McKeon, engineer for Paradigm Developers gave a presentation. Bob Fant stated he is all for the project but didn't
think the council could decide the street issue. Fant made a motion to uphold the decision of the PC and deny the
appeal, Tom Bramlett seconded. Roll call: Bill Burnett, yes; Buddy Curry, yes; Tom Bramlett, yes; Bob Fant, yes; Clay
Dodson, yes. All voted to deny the appeal.
Mayor Barron stated Don Fitzgerald had resigned as building inspector and Richard Whittaker had been filling in.
Mayor Barron recommended hiring a full time building inspector/code enforcement officer. Bob Fant stated it was an
excellent idea to do this and have someone available to enforce the decisions of the Planning Commission. Fant asked
about salary. Mayor Barron stated he thought a salary m the range of $40,000.00 to $45,000.00 would allow us to
hire someone with experience and who could be here when needed. Fant made a motion to create the position of
Building Official with a salary of $45,000.00; Buddy Curry seconded. Roll call: Bill Burnett, yes; Buddy Curry, yes; Tom
Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. All approved. Mayor Barron requested approval of applicant Matt
Bailey, currently an inspector with the City of Springdale, because of his experience and the high recommendations he
had received. Bob Fant made a motion to approve Matt Bailey unless Mayor Barron found anything negative as he
checked more references and was seconded by Buddy Curry. Roll call: Bill Burnett, yes; Buddy Curry, yes; Tom
Bramlett, no; Bob Fant, yes; Clay Dodson, yes.
Mayor Barron asked fora motion to pay the bills for the Genera! and Street Funds which the council had reviewed.
Motion to pay these bills was made by Bob Fant and seconded by Clay Dodson. All approved.
Mayor Barron asked fora motion to adjourn which was made by Buddy Curry and seconded by Clay Dodson. All
approved and the meeting was adjourned at 7:56 PM.
