Minutes of Council Meeting
August 12. 2008


Mayor Lonnie Barren called the council meeting to order at 6:02 PM.
Present were Aldermen Melissia Tomlinson, Bill Burnett, Buddy Curry, Tom Bramlett, Bob Fantand Clay
Dodson. Also present were Police Chief Vernon Sisemore, City Attorney Danny Wright Recorder/Treasurer
Jennifer Allen, Street Superintendent Randy Birchfield, Building Official Matt Bailey, Fire Chief Matt Mills and
Assistant Fire Chief Herb Beitel.
Mayor Barren asked for a motion to approve the minutes of the July 8, 2008 Council meeting. Bob Fant made
a motion to approve the minutes as written and Bill Burnett seconded. All approved.
Monthly Report of Department Heads:
Police Chief Vernon Sisernore stated a 7 year old boy had bitten by a dog. Sisemore stated overall call
volume was down and 21 of 28 cases were closed. Sisemore stated the city still has an animal problem but
he had found out about Boston Mountain Anima! Refuge that works off donations, as opposed to Springdale
charging $50 per animal and were often full and couldn'ttake them. Sisemore stated by ordinance the city
must keep an animal for 5 days after it has been picked up. Discussion was had. City Attorney Danny Wright
stated the city should sign a contract to compensate Boston Mountain and Sisemore stated he will check into it.
Fire Chief Matt Mills stated calls were up 16% from last year. Mills stated JAVFD will be hosting a Haz-mat class.
Street Superintendent Randy Birchfield stated the traffic snare on Main Drive was caused by the installation of two 54-" and one 30" drainage tiles to correct the drainage issues. Mayor Barron stated there was no other
way to repair it without closing the road. Birchfield stated Johnson Road and Elmore Street flood when it rains,
and he would like to put gates there like the ones on Ball Street-Bob Fontotatod ho wa&-for more signage.
Melissia Tomlinson asked how much gates would cost arid Mayor Barron stated in two years when the new
road goes in they won't be needed. Birchfield stated the dirt work and planting around the flag pole will be
completed this week.
Building Official Matt Bailey stated things are picking up as he had issued 16 permits, completed four plan
reviews and 9 code items on abandon houses. Bailey stated he had done a thorough assessment on the rock
rental house and it had been included in the packets.
Recorder/Treasurer Jennifer Allen stated election petitions and political practice pledges needed to be turned
in to city hall by noon on August 25, 2008 for her to file at the county court house, otherwise they would have
to be taken to the courthouse by the candidates themselves before the noon deadline on the 26th.
City Attorney Danny Wright stated this was the 4th month in a row with no new lawsuits. City Attorney Danny
Wright stated the PUD lawsuit goes to trial at the end of the month and he and the Municipal League attorney
are trying to get the city would be dropped from the suit. Wright stated he had some questions for EDA on the
ordinances on maintenance bonds and street design.
Mayor Barron stated that Springdale completed the striping on main Drive and had done an excellent job on
the whole project.
Mayor Barron stated the first meeting on Johnson Road was July 15, 2008 and he doesntthink there is a
chance of it coming in front of city hall. Mayor Barron stated it would be two years before construction would
begin.
Mayor Barron stated the Johnson Community Day held was a success. Mayor Barron stated it was very hot
but a lot of people came. Mayor Barron thanked Linda Youngrnan, Terri Miller and Detective Denny Upton for
their hard work setting it up. Mayor Barron stated the next event sponsored by the Johnson Festival
Committee would be a Christmas program and there had been a tree planted in the city park for this.
Mayor Barron stated the rough in for the Town place Suites Hotel started at the top and they were down to the
2"d floor.
Mayor Barron stated the flag pole donated by Fadi! Bayyari will be dedicated to Barbara Dillard on
Wednesday, August 20, 2008 at 11:30 AM and invited everyone to attend and stay for a luncheon
afterwards.
Mayor Barron stated he had included a copy of the city's fixed assets in the packets for the council's
information.
Mayor Barron stated the value of building permits the c'rty has issued this year is nearly $10.5 million with
about ¥2 of that amount being the hotel.
Mayor Barron stated there is nothing new in the possible de-annexation of South Johnson. Mayor Barron
stated there had been a meeting with the land owners and their attorneys in June but nothing has been
heard since then.
Unfinished Business:
Mayor Barron presented ORDINANCE NO. 200&-10: AN ORDINANCE ANNEXING CERTAIN LANDS THAT ARE
COMPLETELY SURROUNDED BY THE INCORPORATED LIMITS OFTHE CITY OF JOHNSON, AND FOR OTHER
PURPOSES. Mayor Barron stated Mr. Hoyt was not present but that he had talked with him on the phone and
Mr. Hoyt had no objections and asked that the property be annexed in at its current A-l zoning classification.
Mayor Barron asked for a motion to put the ordinance on its third reading by title only. Bob Fant made a
motion to putthe ordinance on its third reading by title only and was seconded by Buddy Curry. Roll call:

yes. City Attorney Danny Wright read the ordinance by title only and Mayor Barron asked for a motion to
approve this third reading. Bob Fant made a motion to approve this first reading and was seconded by Clay
Dodson. Roll call: Melissia Tomlinson, no; Bill Burnett, yes; Buddy Curry, yes; Tom Bramlett, yes; Bob Fant,
yes; Clay Dodson, yes. ORDINANCE 2008-10 was approved.
New Business:
Mayor Barron stated he sent Matt Bailey to do a thorough job evaluating the rock rent house and found that
it was a mistake to have put any money into it to begin with. Mayor Barron stated there were lots of
documented problems and his recommendation was to tear it down and put in a parking lot for the PD with
western access off Ball Street and hopefully eliminate the dangerous street parking. Chief Sisemore stated
there would be parking for the PD vehicles and more public parking. Bob Fantmade a motion to proceed with
tearing it down without cost (in trade for the stone or other salvage) or pursuing bids otherwise. Mayor Barren
stated they would look for someone experienced who could do the complete job. The motion was seconded
by Bill Burnett City Attorney Wright stated the ad in the paper should state the city has the right to refuse
bids and the folks tearing it down needed to be bonded and insured. Mayor Barron stated a contract was

Mayor Barron presented ORDINANCE 2008-14: AN ORDINANCE REQUIRING CERTAIN STRUCTURES TO HAVE
A KEY LOCK BOX INSTALLED ON THE EXTERIOR OF THE STRUCTURE FOR EMERGENCY PURPOSES. Fire Marshall Herb Beitel stated the purpose is to allow emergency personnel to get into the building during an
emergency without having to cause damage to the building and/or wait extensive periods of time for an
owner or manager to arrive with a key. Mayor Barron asked for a motion to read the ordinance by title only.
Buddy Curry made a motion to read the ordinance by title only and was seconded by Bob Fant Roll call:

Mayor Barron presented ORDINANCE 2008-15: AN ORDINANCE ESTABLISHING MINIMUM REQUIREMENTS FOR THE DESIGN AND CONSTRUCTION OF STREETS, ROADS AND STORM DRAINAGE WITHIN THE CITY LIMITS OF THE CITY OF JOHNSON, ARKANSAS AND AMENDING THE CITY CODE, PROVIDING FOR THE EMERGENCY
CLAUSE AND FOR OTHER PURPOSES. BUDDY CURRY made a motion to table this ordinance to allow EDA,
Matt Bailey and Randy Birchfield to get the road closing language added. All approved.
Mayor Barron recognized Alderman Bill Burnett, chairman, Bob Bova, Sue Bova and Dan Cross of the Parks
and Trails Committee. RonTroutman, a trail specialist was also present Bob Bova stated the trail will follow
the south side of Clear Creek to the intersection with the Little Sandy Creek and then cross to the north. Bova
stated the cost estimate is $1.5 million, and they have talked with landowners who are all OK with the
project Burnett stated the committee needed to formalize themselves to begin fund raising and applying for
grants, and get a presentation and recognition program in place to give contributors an incentive to
participate. Discussion was had. Mayor Barron stated he was 100% for this project but doesn't know how much
money the city can contribute atthis time. Buddy Curry stated he agreed with the Mayor and discussion
was had about how to make this project happen. Buddy Curry made a motion support the Parks and Trails
Committee in anyway possible and to have the city grant writer start to work looking for funding. Clay Dodson
seconded and all approved.
Mayor Barron asked for a motion to pay the bills for the Genera!, Street, Act 9S8 and Court Automation Funds
which the council had reviewed. Motion to pay biils was made by Buddy Curry and seconded by Melissia
Tomlinson. All approved.
Mayor Barron asked for a motion to adjourn which was made by Buddy Curry and seconded by Clay Dodson.
All approved and the meeting was adjourned at 7:37 PM.
