Minutes of Council Meeting
December 9. 2008


Mayor Lonnie Barren called the council meeting to order at 6:00 PM.
Present were Aldermen Melissia Tomlinson, Bill Burnett, Buddy Curry, Tom BramletT, Bob Fant and Clay Dodson. Also present were Police Chief Vemon Sisemore, City Attorney Danny Wright,
Recorder/Treasurer Jennifer Allen, Street Superintendent Randy Birchfield, and Fire Chief Matt Mills.
Building Official Matt Bailey was absent
Mayor Barren asked for a motion to approve the minutes of the November 11, 2008 Council meeting.
Bob Fant made a motion to approve the minutes and Buddy Curry seconded. All approved.
Monthly Report of Department Heads:
Fire Chief Matt Mills stated the department had answered 269 calls year to date vs. 272 total calls for all
of last year. Chief Mills stated there had been great response from business owners to the knock
boxes. Chief Mil!s invited everyone to the JAVFD Christmas Dinner on Saturday, December 20th at 6
pm. Chief Mills thanked Danny Hale, Mayor Barron and the council for the equipment grant received.
Mayor Barron stated JAVFD has found fire trucks to look at. Assistant Chief Herb Beitei asked that the
Aldermen please read his report and he appreciates the support of his position.
Police Chief Vemon Sisernore stated there were 8 new cases, 7 closed and 2 pending warrants. Chief
Sisemore stated they had answered 107 false alarms year to date. Chief Sisernore stated activity is in
iine with last year; the officers have been using comp and vacation time. Chief Sisemore asked for the
council's approval to donate a radar unit they have in the box not being used to another town; state law
allows this with council permission. Discussion was had. Bob Fant made a motion to approve the
donation and Buddy Curry seconded. A!! approved. Chief Sisemore stated Fayetteville PD came to
check out our squad cars and were impressed.
Street Superintendent Randy Birchfield stated they had been working on road repair this month, and
the snow plows were up and running. Birchfield stated he didn't know if Kel! Street was a city street or a
private drive, .and he needed to know because there are drainage problems there. City Attorney Danny
Wright stated unless they can show proof that they gave the street to the city, it is a private drive.
Birchfield stated he would sign it accordingly. Birchfieid asked for a one time pay increase of $125 for
city employees. Bob Fant stated this has become an annual item and made a motion to approve with
Melissia Tomiinson seconding. All approved.
Mayor Barron stated since there was inclement weather to the north he had excused Building Official
Matt Bailey from the meeting and his report was in the packet. Mayor Barron stated Bailey was waiting
on completion of the hotel.
Recorder/Treasurer Jennifer Allen stated the city would be remaining with Municipal Health Benefit
Fund; they had increased benefits and moved the city down a class rating which lowered the premiums
and the other carriers were not able to make a big enough difference to justify changing carriers. Alien
requested that each Aldermen turn In their Statement of Financial Interest form for 2008 by January 31,
2009 as required by state law.
City Attorney: Danny Wright stated he had met with the Municipal League attorney on the Neville case
and trial is se't for May 5, 2009; the Setsky case has been dismissed. Wright stated he strongiy
recommenddd the Aldermen attend the meeting Fayetteville Water and Sewer Commission on
Thursday, December 18th at 4:30. Wright stated the having the aldermen there at the last meeting let
Fayetteville know Johnson is serious about getting a contract.
Mayor Barron invited everyone to the city Christmas luncheon on Thursday, December 18th at noon.
Mayor Barron stated it took about 2 hours for the rock house to be demolished. Mayor Barron stated
Chief Sisemore and Randy Birchfieid were working on running a bull dozer to get the lot smoothed out
and make a drive coming out on the west side at Ball Street. Discussion was had about doing away
with the parking on Main Drive.
Mayor Barron stated he was not sure when the hotel would open.
Mayor Barron stated that FEMA had awarded the JAVFD a grant in the amount of $68,472 with the city
matching portion being $3,604.
Mayor Barron stated he still had not heard any more since the State Highway department had gone to
bat for us in trying to get the $32,500 bill for the Little Sandy Creek Bridge dropped by the federal
government.
Mayor Barron stated the Aldermen had received a copy of a list of equipment the city has the
opportunity to buy. Buddy Curry stated he had seen guys like this before and that the brand should be
researched to be sure it is legitimate, if there are parts available if needed and if there is a local office
for the company selling it Mayor Barron stated he would have some research done and bring it back
next month.
Mayor Barron stated Springdale and the engineers support the need to have 5 lanes between f-540 and
Cariey Road pn the Johnson Road project but we have not heard from the State Highway Department.
Mayor Barron1 stated he had been working with the land owner at foe top of the hili and it was possible
he would give the city some property there to build a park.
Mayor Barrori stated the JAVFD has been looking for a fire truck and Assistant Chief Herb Beite! stated
the type of truck needed is called a quint, a pumper with a Sadder, according to the iSO.
Mayor Barrori stated he and Attorney Tom Kiekiak along with a few Aldermen went to the Fayetteville
Water and Sewer Commission meeting and specifically asked that they provide us with a contract to
provide a water and sewer to Johnson. Mayor Barron stated they would be attending the next
Fayetteville Water and Sewer Commission meeting on Thursday, December 18th to get an answer to
this request and asked the Aldermen to attend with them.

Mayor Barren presented ORDINANCE 2008-19: AN ORDINANCE TO ESTABLISH CRITERIA BY WHICH PROPERTY ACQUIRED BY THE CITY OF JOHNSON, ARKANSAS, SHALL BE CLASSIFIED
AS A FIXED ASSET OR EQUIPMENT. Recorder/Treasurer Jennifer Alien stated this ordinance was
required to be in compliance with Legislative Audit. Mayor Barron asked for a motion to read the
ordinance by'title only. Tom Bramiett made a motion to read the ordinance by title only and was
seconded by!Bob Fant Roil call: Melissia Tomlinson, yes; Bill Burnett, yes; Buddy Curry, yes; Tom
Bramiett, yes; Bob Fant yes; Clay Dodson, yes. City Attorney Danny Wright read the ordinance by title
only and Ma^or Barron asked for a motion to approve this first reading. Buddy Curry made a motion to

asked for a motion to suspend the rules and continue on to the second reading by title only. Bob Fant

yes. ORDINANCE 2008-19 was approved.
Mayor Barren presented RESOLUTION 2008-12: A RESOLUTION AMENDING RESOLUTION 2007-10
AND RESOLUTION 2008-09 OF THE CiTY OF JOHNSON, ARKANSAS, AMENDING THE BUDGET
FOR THE PERIOD BEGINNING JANUARY 1, 2008 AND ENDING DECEMBER 31, 2008. City Attorney
Danny Wright read the resolution. Discussion was had about the changes which included 48m Street,
Main Dr., and drainage. Bob Fant made a motion to approve Resolution 2008-12 and was seconded by
Buddy Curry. All approved.
Mayor Barron presented RESOLUTION 2008-13: A RESOLUTION PROVIDING FOR AND ADOPTING
A BUDGET FJOR THE CITY OF JOHNSON, ARKANSAS, FOR THE TWELVE (12) MONTHS
BEGINNING JANUARY 1, 2009 AND ENDING DECEMBER 31, 2009, APPROPRIATING MONEY FOR EACH AND EVERY ITEM OF EXPENDITURE THEREIN PROVIDED FOR AND FOR OTHER PURPOSES.; City Attorney Danny Wright read the resolution. Buddy Curry stated figures for both 5%
an 6% raises;were given. Mayor Barron stated he had checked with surrounding towns and they were
in the 5-6% range and the budget presented included 6% raises. Discussion was had. Curry stated
Great House Springs Road from I-540 to the city limits was the worst road in town and it was being
used more than ever and was glad to see the overlay and striping being budgeted for. Bob Fant made
a motion to approve Resolution 2008-13 and was seconded by Buddy Curry. AH approved.
Mayor Barren asked for a motion to pay the bills for the General, Street, Act 988 and Court Automation
Funds which the council had reviewed. Motion to pay bills was made by Bob Fant and seconded by
Buddy Curry. All approved.
Mayor Barron asked for a motion to adjourn which was made by Buddy Curry and seconded by Tom
Bramlett. All approved and the meeting was adjourned at7:00 PM.
