March 11. 2008


Mayor Lonnle Barren called the council meeting to order at 6:00 PM.
present were Aldermen Bill Burnett, Buddy Curry, Bob Fant and Clay Dodson. Also present were C'rty Attorney Danny
Wright, Recorder/Treasurer Jennifer Allen, Street Superintendent Randy Birchfietd, Lt John Taylor of JPD and Asst. Fire
Chief Herb Beftel. Aldermen Melissia Tomlinson and Tom Bramfett, Police Chief Vernon Sisemore, Fire Chief Matt Mills
and Building Official Matt Bailey were all absent.
Mayor Barron thanked the council and the people who work for the city for their help during his illness, especially
Jennifer Allen and Danny Wright who took care of everything.
Mayor Barron asked for a motion to approve the minutes of the February 12, 2008 Council meeting. Bob Fant made a
motion to approve the minutes as written and Buddy Curry seconded. All approved.
Monthly Report of Department Heads:
Mayor Barron stated Police Chief Vernon Sisemore had the flu and recognized Lt John Taylor. Taylor stated JPD had
opened 24 cases and closed 23. Taylor stated new hire Jimmy Wicker would be at the next meeting to be introduced
to the council.
Asst. Fire Chief/Fire Marshal Herb Bertel stated the Johnson Area Volunteer Fire Department overall calls for service
year to date were up 60%, F.MS calls up 5Q%. Beitel stated he had officially started 2/18/08 as Rre Marshal and has
done 21 inspections.
Street Superintendent Randy Birchfieid stated he had been working wrth Danny Hale, the city grant writer, on a storm
siren grant. Birchfield stated the city has a great chance to get the siren and the best place to put it is at the top of
Carley Hill and Ozark Bectric has agreed to have it placed on ttteir property. Mayor Barron stated he thinks Ozark
Electric will trade electricity for the siren for mowing this summer. BirchfieEd stated the unit has a battery backup.
Birchfield stated construction on 48*1 Street has begun and the old asphalt has been scraped up.
Mayor Barron stated Building Official Matt Bailey is attending a funeral and his report is in the packets.
Recorder/Treasurer Jennifer Allen stated HO letters were sent to local businesses in January and 79 business
licenses have been purchased. Allen stated second reminder letters would go out by the end of the week.
City Attorney Danny Wright stated a new lawsuit had been delivered today, a former employee is suing the city and
Chief Sisernore and he will send ft to the Municipal League to be reviewed. The Municipal League has agreed to defend
the city in the Burton Lawsuit regarding the rezoningof the P.U.D. and their lawyers wif! be here on March 12, 2008.
Wright stated he doesn't hold out hope the parties will settle. Wright stated the Hder's lender is concerned a bout their
property not being properly zoned since the city changed the ordinance last year. Wright stated the change in the
zoning ordinance was not intended to cause hardship, Wright stated one appeal is pending, and Detective Denny Upton
did a great job in investigating in the beginning making the whoie process easier.
Mayor Barron stated Cost Sharing Plan for Main Drive was signed the end of February and Springdale will start work in
May, the first project on their fist. Mayor Barron stated the difference En the dump truck cost is due to quantity to be
hauled and our part will require they hire extra trucks.
eMayor Barron stated the Johnson Festival Committee has scheduled the I** annual Easter E^ Hunt this Saturday in
Johnson Park and the info in the packets was sent to Johnson addresses only. Mayor Barron stated Johnson Baptist
Fellowship is eagerly helping with all areas and the event has had many contributions from focal businesses. Mayor
Barron stated the JFC has also scheduled a City Wide Yard Sale to be held the first weekend in May in the triangle area
by Hewitt & Ball SL
Mayor Barron stated the council had received copies of the articies in Times regarding the Fayetteville Committee
recommendation to complete Van Asche and de-annex adjacent property from Johnson to Fayetteville. Mayor Barron
stated his first knowledge of this was reading the plan in paper, there had been no communication at all. Mayor
Barron stated there would be a meeting to be held with Gary Dumas to discuss options. Buddy Curry stated that being
sandwiched between 2 big cities we need to fight this all we can.
Unfinished Business:
Mayor Barron stated they are working on 48^ Street and APAC thinks rt will be a fairly quick project Mayor Barron
stated he had given Mayor Jerre Van Hoose permission to put up signs giving directions to the Arvest Ballpark.
Mayor Barron presented RESOLUTION 2008-06: A RESOLUTION TO APPROVE AND AUTHORIZE EXECUTION OF A NEW
CONTRACT FOR TRASH COLLECTION AND RECYCLING. Crty Attorney Danny Wright stated the resolution should say
Johnson not Elkins, Labor Day should be included in the holidays in paragraph 8 , and in paragraph 1O the
performance bond of $5,OOO.OO was too low, but Roll Off has agreed to $15,OOO.OO. Wright read the resolution. Bob
Fant made a motion to approve Resolution 2GO8-05 and was seconded by Clay Dodson. Roll call; Bill Burnett, yes;
Buddy Curry, yes; Bob Fant, yes; Clay Dodson, yes. RESOLUTION 2008-O6 was approved.
City Attorney Danny Wright presented ORDINANCE 2OO8-O3: AN ORDINANCE APPROVING AN INTERLOCAL
AGREEMENT FOR AMBULANCE SERVICES ("AGREEMENT7} BETWEEN WASHINGTON COUNTY, ARKANSAS ("COUNTY")
AND THE CITIES OF ELKINS, FARMfNGTON, FAYETTEVILLE, GOSHEN, GREENLAND, LINCOLN, PRAIRIE GROVE, WEST
FORK, WINSLOW AND JOHNSON ('OTIES"). Wright stated that it was to be considered again by Fayetteville and we
could give It one readingthis month. Mayor Barron asked for a motion to read the Ordinance by title only. Bob Fant
made a motion to read the ordinance by title only and was seconded by Clay Dodson. Roll caU: Bill Burnett, yes; Buddy

New Business:
Mayor Barron introduced ORDINANCE 2QOS-06: AN ORDINANCE TO AMEND THE ZONING DISTRICT CLASSIFICATION
AND BOUNDARIES REGARDING PROPERTY IDENTIFIED IN REZONiNG PETITION 2O08-O1 OF CSK HOTELS. Mayor Barron
stated the hotel will be called Townplace Suites, a division of Marriot and the building permit will cost over $30,000.
Buddy Curry stated this was approved by the Planning Commission February 26, 2008 and would put this lot In the
correct the zoning since the new ordinance passed. City Attorney Danny Wright stated the ordinance would be given 3
readings tonight and it will go into effect in 31 days. Curry stated the final plat for the rest of the Maverick Properties
subdivision had been tabled since none of the promises made by tfte developers had been completed. Mayor Barron
asked for a motion to read the Ordinance by titie only. Bob Fant made a motion to read the ordinance by title only and

Mayor Barron stated the next item on the agenda was not needed as it was passed at the November 20, 2007 special
council meeting.
Mayor Barron.asked for a motion to pay the biffeforthe General, Street. Act 988 and Court Automation Funds which
the council had reviewed. Motion to pay these bills was made by Bob Fant and seconded by Buddy Curry. All
approved.
Mayor Barron asked for a motion to adjourn which was made by Bob Fant and seconded by Buddy Curry.
Ail approved and the meeting was adjourned at 6:53 PM.
