Minutes of Council Meeting
October 14, 2008


Mayor Lonnie Barron called the council meeting to order at 6:00 PM.
Present were Aldermen Bill Burnett, Buddy Curry, Bob Fant and Clay Dodson. Also present were
Police Chief Vernon Sisemore, City Attorney Danny Wright, Recorder/Treasurer Jennifer Alien, Street
Superintendent Randy Birchfield, and Assistant Fire Chief Herb Beitel. Building Official Matt Bailey and
Aldermen Tom Bramlett and Melissia Tornlinson were absent.
Mayor Barron asked for a motion to approve the minutes of the September 9, 2008 Council meeting.
Bob Fant made a motion to approve the minutes and Buddy Curry seconded. A!! approved.
Monthly Report of Department Heads:
Police Chief Vernon Sisemore stated there were 26 new cases: 10 closed and 5 pending. Chief
Sisemore stated Ozark Mountain Animal rescue had taken 4 animals for S120.00. Chief Sisemore
stated one of the units needed a new camera system and asked for the council's approval to purchase
a new one at $6,000.00 to be paid out of Act 988. Bob Fant made a motion to approve the purchase
and Buddy Curry seconded. All approved.
Assistant Fire Chief Herb Beitei stated the aldermen had received a copy of the Fire Department's
budget. Mayor Barron stated it was in excess of what we can provide but we will the work on it.
Street Superintendent Randy Birchfield stated they had cut up 15 trees and helped residents clean up
after the last round of storms. Birchfield stated the drainage had been completed at Mary Street and
was working well. Birchfield stated the Aldermen had received a flier about Project Realtor; they are
cleaning up behind the nursing home and gathering trash on Bail Street. Birchfield stated Johnny Seals
quit and the ad run for a replacement had generated 54 applications. Birchfield stated there were 8
dumpsters filled during Fall Cleanup.
Building Official Matt Bailey was absent and Mayor Barron stated his report is in the packet.
Recorder/Treasurer Jennifer Alien stated she had nothing to report.
City Attorney Danny Wright stated he had received a letter formally releasing the City from the Burton
lawsuit. Wright stated there were 2 appeals pending in the circuit court. Wright stated his contract for
2009-2010 will be available for review before the next meeting.
Mayor Barron stated he had received a request from Springdale to pay for signage for a bike path they
were proposing for 48th to Main Drive to Cartey Road to Don Tyson Parkway. It was agreed by ail that
biking on Main Drive was not safe and Mayor Barron stated he would call Springdale and let them know
the council's feeiings and decline the request to pay for half of the signs.
Mayor Barron stated an ad had been run to see if anyone would take the rock rent house down with no
luck and at this point we would sell anything we couid, but it needs to come down.
Mayor Barron stated he was told the hotel would be done by November 1st; the top 3 floors are about
finished.
Mayor Barron stated the drainage has been finished at the Maverick Development and they have done
what they agreed to do.
Mayor Barron stated the State Highway department had gone to bat for us in trying to get the $32,500
bill for the Little Sandy Creek Bridge Mayor Long had had designed dropped by the federal
government..
Mayor Barron stated that he had received an email asking more questions, but was given an amount of
372,076 for the fire department grant with S3.604 being the city's share. Mayor Barron stated the
money would come through Senator Boozman's office.
Mayor Barron stated that Rolioff Services had added a fuel surcharge of S5.98 to resident's bills this
quarter and this was not in our contract with them. Mayor Barron stated residents couid either leave
that amount out of their payment or receive a credit on their next biil.
Mayor Barron stated there had been a meeting with the engineers who are designing the Johnson
Road project and Springdale supports the need to have 5 ianes between 1-540 and Cariey Road.
Mayor Barron stated the city had received Setters from W. G. Land Company and David McClinton
asking for water, sewer and the ability to provide high rise building fire protection. Fayetteviile will
provide water per their own letter, our engineers can put in a sewer, and we have already been looking
for a refurbished fire truck to fight fires in other taller buildings like the Chambers Bank Building and the
new hotel. Mayor Barron stated the city has sent a letter back stating we will do ail of the above, but
they need to give us more detailed information about what they are going to build so we can know what
we need to provide. Mayor Barron stated he didn't see any other way but to fight for the city's land.
Mayor Barron stated there has been no contact in 6 weeks and the up coming election may change the
attitude of Fayetteviile. Mayor Barron stated he wasn't asking the council to take any action now, but he
had given them a copy of the law and he wanted them to read and study it. The council supported the
Mayor and told him to keep after it. Fred Barker stated a Fayettevilie alderman had mentioned this in
the past and wanted to know who is pushing this. Mayor Barron stated the city had asked Fayetteviile if
they had called the meetings or if the landowners had and got no response.
Unfinished Business:
Mayor Barron presented ORDINANCE 2008-15: AN ORDINANCE REPEALING CHAPTER 9.6 IN THE
JOHNSON MUNICIPAL CODE AND ESTABLISHING MINIMUM REQUIREMENTS FOR THE DESIGN
AND CONSTRUCTION OF STREETS, ROADS AND STORM DRAINAGE WITHIN THE CITY LIMITS
OF THE CITY OF JOHNSON, ARKANSAS AND AMENDING THE CITY CODE, AND FOR OTHER
PURPOSES. Buddy Curry thanked Randy Bfrchfield for getting the street cut wording in there. Mayor
Barron asked for a motion to read the ordinance by title only. Buddy Curry made a motion to read the

New Business:
Mayor Barron presented ORDINANCE 2008-18: AN ORDINANCE LEVYING A TAX ON THE REAL
AND PERSONAL PROPERTY WITHIN THE CITY OF JOHNSON, ARKANSAS,, FOR THE YEAR 2009
FIXING THE RATE THEREOF AT 5.0 MILS AND CERTIFYING THE SAME TO THE COUNT/ CLERK
OF WASHINGTON COUNT/, ARKANSAS. Mayor Barren asked for a motion to read the ordinance by
title only. Bob Fant made a motion to read the ordinance by title only and was seconded by Ciay
Dodson. Roll call: Bill Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Ciay Dodson, yes. City Attorney
Danny Wright read the ordinance by title only and Mayor Barron asked for a motion to approve this first

Mayor Barron presented RESOLUTION 2008-10: A RESOLUTION ADOPTING THE HAZARD
MITIGATION PLAN FOR WASHINGTON COUNTY. City Attorney Danny Wright read the resolution and
Mayor Barron asked for a motion to approve. Bob Fant made a motion to approve the resolution and
Buddy Curry seconded. All approved.
Mayor Barron stated the budget for 2009 is being prepared and the 2008 budget will be adjusted in
December. Mayor Barren stated all department heads have been asked to tighten their belts as sales
tax is not off from last year, but is less than budgeted.
Mayor Barren asked for a motion to pay the bills for the Genera!, Street, Act 988 and Court Automation
Funds which the council had reviewed. Motion to pay bills was made by Bob Fant and seconded by Bill
Burnett. All approved.
Mayor Bsrron asked for a motion to adjourn which was made by Bob Fant and seconded by Buddy
Curry. All approved and the meeting was adjourned at 7:07 PM.
