Mayor Lonnie Barren called the council meeting to order at 6:00 PM.
Present were Aldermen Bill Burnett, Buddy Curry, Tom Bramlett, Bob Fant and Clay Dodson. Also
present were Police Chief Vemon Sisemore, City Attorney Danny Wright, Recorder/Treasurer Jennifer
Allen, Street Superintendent Randy Birchfield, Building Official Matt Bailey, and Fire Chief Matt Mills.
Alderman Melissia Tomlinson was absent.
Mayor Barton asked for a motion to approve the minutes of the August 12, 2008 Council meeting. Bob
Fant asked that the comment attributed to him about signage in the Street Department report be
removed. Tom Bramlett made a motion to approve the corrected minutes and Bob Fant seconded. All
approved.
Monthly Report of Department Heads:
Police Chief Vernon Sisemore stated Ozark Mountain Animal Refuge would pick up animals for $30
each, or S30 per family if there were pups or kittens; they won't take pit bulls, but they will take pit
puppies. City Attorney Danny Wright stated the council needed to authorize Chief Sisemore to enter
into and sign an agreement with Ozark Mountain Animal Refuge to provide this service. Bob Fant made
a motion to authorize Chief Sisemore to enter into and sign an agreement with Ozark Mountain Animal
Refuge to provide animal pick up and was seconded by Buddy Curry. All approved.
Chief Sisemore stated there had been 6 false alarms in August with 79 year to date. Chief Sisemore
stated 18 new cases were opened, 7 cases were closed and 2 were pending. Chief Sisemore stated
officers were using their vacation, and the new rooms were almost complete after moving an ac return.
Fire Chief Matt Mills stated calls were up 11 % from last year. Chief Mills stated 75% of JAVFD fire
fighters were certified in Haz-mat control and clean up. Chief Mills stated they were having some
equipment issues and were looking into getting a new fire truck to fight fires in higher floor buildings.
City Attorney Danny Wright asked if there was room to park and get this kind of truck in and out.
Discussion was had.
Street Superintendent Randy Birchfield stated Fall Clean Up would be September 20th through October
5, 2008. Birchfield stated they were worried about weather last week but there was no flooding.
Building Official Matt Bailey stated he had issued 14 permits, 6 certificates of occupancy and approved
four business licenses. Bailey stated he had the state review materials from the rock rental house and it
had less than 150 square feet of asbestos and it could be demolished as is.
Recorder/Treasurer Jennifer Allen stated there were no contested races in the City of Johnson in the
fall election.
City Attorney Danny Wright stated this was the 5th month in a row with no new lawsuits and had been
dropped from the PUD lawsuit. Wright stated Mayor Barron and Chief Mills needed to get the fire
^^ agreement worked'out as requested by the auditor. Wright stated because of some issues with getting
^^ public defenders to work in city courts, he would now be trying those trials on behalf of the city in the
Springdale court.
Mayor Barron stated the flag pole and courtyard dedicated to Barbara Dillard really dressed up City
Hall.
Mayor Barron stated he was still trying to get the $32,000 bill for the Little Sandy Creek Bridge Mayor
Long had designed dropped by the state.
Mayor Barron stated there is nothing new in the South Johnson situation. Mayor Barron stated he and
our attorneys have been negotiating mostly by correspondence, and nothing will be done without the
council's approval.
Mayor Barren stated that the city hopefully has been awarded a fire department grant for equipment to
be presented by Senator Boozman; we won't know for sure until his office calls. Mayor Barron stated
the city had not been turned down for a fire truck grant, but if we are, the application would be
immediately refiled.
Unfinished Business:
Mayor Barron presented ORDINANCE 2008-15: AN ORDINANCE ESTABLISHING MINIMUM
REQUIREMENTS FOR THE DESIGN AND CONSTRUCTION OF STREETS, ROADS AND STORM
DRAINAGE WITHIN THE CITY LIMITS OF THE CITY OF JOHNSON, ARKANSAS AND AMENDING
THE CITY CODE, PROVIDING FOR THE EMERGENCY CLAUSE AND FOR OTHER PURPOSES.
Buddy Curry asked if the street closing language had been added and Street Superintendent Randy
Birchfield said no. Curry made a motion to table the ordinance again until that correction had been
made and was seconded by Tom Bramlett. All Approved.
Mayor Barron presented ORDINANCE 2008-16: AN ORDINANCE ESTABLISHING THE MINIMUM
BOND REQUIREMENTS WITHIN THE CITY LIMITS OF JOHNSON, ARKANSAS AND FOR OTHER
PURPOSES. Mayor Barron asked for a motion to read the ordinance by title only. Bob Fant made a
motion to read the ordinance by title only and was seconded by Buddy Curry. Roll call: Bill Burnett,
yes; Buddy Curry, yes; Tom Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. City Attorney Danny
Wright read the ordinance by title only and Mayor Barron asked for a motion to approve this first
reading. Bob Fant made a motion to approve this first reading and was seconded by Clay Dodson. Roll
call: Bill Burnett, yes; Buddy Curry, yes; Tom Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. Mayor
Barron asked for a motion to suspend the rules and continue on to the second reading by title only.

New Business:
Mayor Barron presented ORDINANCE 2008-17: AN ORDINANCE ESTABLISHING APPROVAL OF
FINAL PLAT FOR A LARGE SCALE DEVELOPMENT TO BE CALLED MAVERICK COMMERCIAL
PARK. Buddy Curry asked what progress had been made since the Planning Commission meeting.
Tom Henley of H2 Engineering stated they have a contract and letter of credit to construct the new
drainage and have 50% of the storm drainage improvements done. Henley stated they had started on
the north side to get Great House Springs Road cleaned up and put in a change order to get west turn
lane from 50' to 200' and then the striping will be done. Henley stated they were going to pour a
concrete channel on the east side for drainage and they have a letter from the engineer of the retaining
wall that it needs an earthen buttress 3' high and they will taper it out. Henley stated the hotel had
above ground electric that SWEPCO will run underground through a new conduit. Curry asked what the
benefit of passing the ordinance for the final plat tonight would be. Henley stated the rest of the project
will be done earlier than the next meeting and it is to everyone's benefit to get it done and sell lots to
bring in business and benefit the city. Matthew Dearnley, one of the property owners stated it is difficult
to sell lots when the answer to when closing will be is, "I don't know." Henley stated it is beneficial to be
able to say the Planning Commission and the City Council have approved. Bob Fant asked what would
happen if the ordinance wasn't signed. City Attorney Danny Wright stated if the ordinance was passed,
Mayor Barron would have to sign it unless there were stipulations made that it couldn't be until the
project was completed. Fant asked Henley if it was OK with him to pass the ordinance and stipulate that
the Mayor not sign it or the final plat until the work was complete and Henley said yes. Discussion was
had. Fant made a motion to pass the ordinance and plat with the stipulation that the ordinance and plat
not be signed until the work has passed a final inspection by both Matt Bailey and EDA and was

ORDINANCE 2008-17 WAS APPROVED.
Mayor Barron stated a meeting on the proposed new route of Johnson Road was September 1 0, 2008
here at city hal! at 2:00 pm and showed a large scale copy of the map.
Mayor Barron asked for a motion to pay the bills for the General, Street, Act 988 and Court Automation
Funds which the council had reviewed. Motion to pay bills was made by Bob Fant and seconded by
Buddy Curry. All approved.
Mayor Barron asked fora motion to adjourn which was made by Bob Fant and seconded by Buddy
Curry. All approved and the meeting was adjourned at 7:05 PM.
