Minutes of Council Meeting
February 10, 2009
Mayor Lonnie Barren called the council meeting to order at 6:00 PM.
Present were Aldermen Melissia Tomlinson, Bill Burnett, Buddy Curry, Tom Bramlett, Bob Fant and
Clay Dodson. Also present were Police Chief Vernon Sisemore, City Attorney Danny Wright,
Recorder/Treasurer Jennifer Allen, Building Official Matt Bailey, Street Superintendent Randy Birchfield,
and Fire Chief Matt Mills.
Mayor Barron asked for a motion to approve the minutes of the January 13, 2009 council meeting. Tom
Bramlett made a motion to approve the minutes and Buddy Curry seconded. All approved.
Monthly Report of Department Heads:
Police Chief Vernon Sisemore stated there were 16 new cases in January and 12 had been closed.
Chief Sisemore stated the department had answered 96 calls for service, 76 during or after the ice
storm. Chief Sisemore stated the officers worked 56 hours of overtime during the storm and the
aftermath; they were very busy! Chief Sisemore stated citations vs. warnings were about even.
Fire Chief Matt Mills stated the department had answered 54 call year to date compared to 24 last year;
33 were storm related - 14 overnight on Tuesday January 27th alone. Chief Mills praised his guys for the
tremendous job they did and thanked Assistant Chief Herb Beitel for his leadership.
Street Superintendent Randy Birchfield thanked both the Police and Fire Departments for assistance
during the storm and praised his guys for doing such a great job. Birchfield stated they have begun the
slow process of clean up, but they'd get it done.
Mayor Barron thanked all three departments stating they had all gone beyond the call of duty during
this disaster getting the streets open and making progress in the clean up.
Building Official Matt Bailey stated there was not much happening permit wise but people are talking
about new projects. Bailey stated he was helping with FEMA and the environmental people. Bailey
stated he was working on Business Licenses and address confusion.
Recorder/Treasurer Jennifer Allen thanked Chief Sisemore for getting the generator going so she could
process payroll and make sure our employees were taken care of.
City Attorney Danny Wright stated it had been 11 months since the city had been sued. Wright stated
the Hoskins case has never gone to trail and that Fayetteville was involved now, but we are out of it.
Wright stated the previous flood prevention ordinance was passed with a defective clause and there
was a new one tonight that needed to be passed with three readings and an emergency clause to
correct the errors in the other.
Mayor Barron stated the city had started a staging area for debris in the triangle at Hewitt and Ball
Streets, but that area was not acceptable by ADEQ. Mayor Barren stated Springdaie gave permission
to burn by the lift station south of Main Drive. Mayor Barren stated our two options to get rid of the
debris were to chip it @ $15,000.00 just to bring in the machine or bum it JAVFD will help with the
burn, but nothing will be done until FEMA measures it. Mayor Barren stated he had signed the disaster
declaration form.
Mayor Barren stated we had to use the two generators that we weren't going to buy because we
needed them during the power outage after the storm, but the city needs to get a permanent generator
for the PD and City Hall that goes on automatically when the power goes off and is run by natural gas.
Mayor Barron stated we are supposed to be able to bring folks here in an emergency as this is the
command center for the city, but we couldn't because there was no power. Mayor Barron stated we
would look at options next month and look for grant money.
Mayor Barron stated the owner of the company is bringing the fire truck down from Springfield
personally on Thursday. Mayor Barron stated everything on the truck is warranted and they will provide
training for its use. Mayor Barron stated the purchase should lower our ISO rating from a 5 to a 4.
Mayor Barron stated we had been removed from the agenda at tonight's Fayetteville Water and Sewer
Commission meeting by request of Mayor Lioneld Jordan so he and Mayor Barron could meet to work
things out. Mayor Barron stated he was hopeful as he would rather have the Fayetteville mayor present
a water and sewer contract to the Fayetteville City Council. Mayor Barron stated either way, our counsel
is prepared for whatever comes.
Mayor Barron stated there had been many companies offer to help clear the storm debris, some good
and some bad. Mayor Barron stated he had thoroughly checked out Arbor Master Tree service,
represented by Randy Clifton and Chuck Ohlrich, and they had excellent references. Mayor Barron
stated he had made no commitment to them until we know if FEMA will fund the project, but that he
believed we could contract up to 70 hours without a bid for disaster clean up. Mayor Barron stated Pat
Bretton with SSK had cleaned up Main and Wilkerson and Arbor Masters was willing to employ him to
help them. Clifton stated he thought Arbor Masters could do the job in 70 hours and they have 10
certified arborists. Mayor Barron stated the city was meeting with FEMA in the morning and that City
Attorney Danny Wright would have to look at the contract. Buddy Curry asked if we could have a
motion to approve now to get the process started and Wright said yes. Bob Fant made a motion to hire
Arbor Maters for tree work and debris clean up subject to approval of the contract Buddy Curry
seconded and the motion passed 4-2 with Bill Burnett and Tom Bramlett against.
Mayor Barron stated the city needs a new fire station on the west side of town and that he had
appointed a committee to locate a site. Bill Burnett made a motion to approve the committee as listed
and was seconded by Bob Fant. All approved.

Mayor Barron presented ORDINANCE 2009-01: AN ORDINANCE PROVIDING FOR THE
ESTABLISHMENT OF A FLOOD DAMAGE PREVENTION PROGRAM FOR THE CITY OF JOHNSON.

REPEALING ORDINANCE 2008-07; AND FOR OTHER PURPOSES; AND DECLARING AN
EMERGENCY TO EXIST. Mayor Barren asked for a motion to read the ordinance by title only. Buddy
Curry made a motion to read the ordinance by title only and was seconded by Tom Bramlett. Roll call:

motion to approve this first reading. Buddy Curry made a motion to approve this first reading and was

2009-01 was approved.
Mayor Barron presented RESOLUTION 2009-04: A RESOLUTION TO APPLY FOR A FIRE TRUCK
GRANT. The resolution was read by City Attorney Danny Wright. Mayor Barron asked for a motion and
Bob Fant made a motion to approve Resolution 2009-04 and was seconded by Buddy Curry. All
approved.
Mayor Barron presented RESOLUTION 2009-05: A RESOLUTION OF THE CITY OF JOHNSON,
ARKANSAS, CERTIFYING LOCAL GOVERNMENT ENDORSEMENT OF PACIFIC VET GROUP TO
PARTICIPATE IN THE TAX BACK PROGRAM (AS AUTHORIZED BY SECTION 15-4-2706(d) OF THE
CONSOLIDATED INCENTIVE ACT OF 2003). Buddy Curry made a motion to postpone discussion of
the resolution until a representative could be present to answer questions. Tom Bramlett seconded and
all approved.
Mayor Barron asked the council to approve the purchase of the emergency equipment during the storm.
Bob Fant stated it was an emergency situation and made a motion to approve the purchase and Tom
Bramlett seconded. Motion approved with Buddy Curry voting no.
Mayor Barron asked for a motion to pay the bills for the General, Street, Act 988 and Court Automation
Funds which the council had reviewed. Buddy Curry asked about a bill buying out a contract form
Cintas and Mayor Barron stated it was a five year contract signed by Mayor Long. Motion to pay bills
was made by Tom Bramlett and seconded by Buddy Curry. All approved.
Mayor Barren asked for a motion to adjourn which was made by Bob Fant and seconded by Tom
Bramlett All approved and the meeting was adjourned at 7:25 PM.

Minutes of Special Called Council Meeting
February 13, 2009
Mayor Lonnie Barren called the council meeting to order at 2:00 PM.
Present were Aldermen Melissia Tomlinson, Bill Burnett, Buddy Curry, Tom Bramlett, and Bob Fant.
Also present were Recorder/Treasurer Jennifer Allen and Building Official Matt Bailey.
Mayor Barren stated that the 70 hour post emergency time had expired and the city was required by
FEMA to put the tree trimming and debris removal contract out for bid. Mayor Barren stated that there
are requirements in situations like this that have to be accepted. Mayor Barron reminded the council
they did not have to accept the lowest bid.
Bids submitted were opened by Mayor Barron randomly as follows:
1) SSK Red Dirt Sales - determined to be bill for clean up already completed.
2) Langston Tree Service, Wanda Langston, owner. Certified arborist, article of incorporation in Florida;
liability insurance of $1,000,000.00 (certified); no bond; 4 references in Florida; past performance
record for hurricanes/storms; EHAP and ISA certified. Bid $92,000.00
3) Phillips and Jordan, Inc. Licensed for heavy equipment and construction by State of Arkansas;
liability insurance e of 310,000,000.00 (certified); certified for movement of large equipment in
Arkansas; certified arborist. Bid $244,999.00.
4) Powell Emergency Services, LLC, Booneville, AR. Certified arborist; liability insurance of
$1,000,000.00; department of transportation references; letter of explanation; stated they were EHAP
certified. Bid $88,500.00.
5) Rick Parshall Building Company, Prairie Grove, AR. Liability insurance of 32,000,000.00; contractors
license; scope of work; letter explaining company. Bid $287,000.00.
6) Arbor Masters Tree Service, Shawnee, KS - Oklahoma City, OK. Liability insurance, $500,000.00,
plus $100,000.00 per employee; references, letters; TCIA accredited; EHAP line certified; ISA certified
arborists (5 total - 2 present at bid opening); 3 pages scope of work. Bid $88,799.00.
In discussion, bids 3 & 5 were eliminated due to excessive cost, bid 2 was eliminated due to no
representative being present, and bid 1 was actually a bill not a bid.
Bid 4 - Powell Emergency Services stated they expected to clean city and trim trees properly and Bid 6-
Arbor Masters Tree Service stated yes there is debris on the ground, but there is primarily a tree
problem. Discussion was had and questions were asked of both companies.
Mayor Barron state both companies had worked for and with FEMA; both were willing to wait for
payment until the city was paid by FEMA; both willing to hire local contractors; both stated the people
doing the bucket work would be wire certified: Powell stated they would start with 2-3 trucks, Arbor
Masters stated they would start with 4. Buddy Curry stated Arbor Masters was really concerned about
the trees and he was, too. Melissia Tomlinson stated she like Powell because they were an Arkansas
company. Bob Fant made a motion to accept the bid of $88,500.00 and hire Powell Emergency
Services and Tom Bramlett seconded. Motion approved with Buddy Curry voting no.
