JOHNSON CITY COUNCIL
MEETING MINUTES
OCTOBER 13, 2009


Mayor Lonnie Barron called the meeting to order at 6:00 pm.
Present were Aldermen Bill Burnett, Buddy Curry, Bob Fant and Clay Dodson. Also present were
Recorder/Treasurer Jennifer Allen, City Attorney Danny Wright, Police Chief Vemon Sisemore, and Fire
Chief Matt Mills. Council members Melissia Tomlinson and Tom Bramlett and Street Superintendent
Randy Birchfield were absent.
Mayor Barron asked fora motion to approve the minutes of the Sept. 9,2009 council meeting. Clay
Dodson said he was absent from the meeting. Bob Fant made a motion to approve the minutes with that
correction and Buddy Curry seconded. All approved.
Department Head Reports:
Police Chief Vernon Sisemore stated there had been 25 new cases opened with 17 closed. Chief
Sisemore thanked the Fired Department for their assistance during the recent rainstorm. Chief Sisemore
stated an officer had been let go for policy violations. Chief Sisemore stated two new officers had been
hired to fill the vacancies.
Fire Chief Matt Mills stated that calls were down from last year. Mills stated they had been doing lots of
cross training and had a truck operations class.
Mayor Barron stated Street Superintendent Randy Birchfield had been excused due to having surgery on
both legs, but he was doing well. Mayor Barron stated two new employees had started October 1, 2009
and the department was now fully staffed.
Mayor Barron stated Building Official had not been replaced yet. Mayor Barron stated there was no
Planning Commission Meeting in September.
Recorder/Treasurer Jennifer Allen stated budgeting for 2010 was underway and invited the Aldermen to
contact her with anything they would like to see included. Allen stated she had contacted ADEM again
about the state's portion of reimbursement for the ice storm expenditures totaling over $15,000.00.
City Attorney Danny Wright stated the condemnation of the McClinton property was completely finished,
they agreed to the $68,000.00, and it is now the city's properly. Wright stated with regard to the lawsuit
by W.G. Land Company we filed a motion for dismissal, they answered, we countered and the matter is
now set for a<j5jĀ£gtriaDon November 13, 2009 at 9:00 am. Wright stated Matt Bailey's situation
compromises the city's position in the Powell Emergency Services surt. Wright stated that he would like
to offer them $5,000.00 - $7,500.00 to settle it and have it over. Bob Fant asked Wright if Bailey was
against us and Wright replied that there had been moraf compromises before Bailey's resignation.
Discussion was had. Buddy Curry stated he did not want to give them a penny, but he made a motion to
offer them $5,000.00 with a maximum of $7,500.00. Bob Fant seconded. Wright stated the PD is doing a
good job and there are no current appeals. Roll call: Bill Burnett, yes; Buddy Curry, yes; Bob Fant, yes;
Clay Dodson, yes.
Mayor Barron stated the fall clean up went well.
Mayor Barron stated the Johnson Post Office would stay open.
Mayor Barron stated Johnson Road is still scheduled to be let for bid in February or March of 2010.
Mayor Barron stated the Johnson Trail Committee had a luncheon at Clear Creek Hospital to raise
money for engineering and they were still working on it.
Mayor Barton stated census day will be April 1, 2010 and asked those present to please take a reminder
tote bag with them. Mayor Barren stated that the city purchased the bags to promote the Census and
they were paid for by the Census Bureau.
Mayor Barron stated the PD parking lot was complete but the wall still needed to be built.
Mayor Barron stated they were working on the generator project.
Mayor Barron stated S. 48th Street has had surveying and engineering work done. Mayor Barron stated
the city is still looking at putting in a sewer system. Mayor Barron stated that he and Jennifer Allen had
met with the bankers to discuss possible financing.
Mayor Barron stated Trunk or Treat was being held at the Shops at the Mill on Halloween night.

Mayor Barron recommended Paul Sullins as the new Building Official. Mayor Barron stated Sullins had
never been a building inspector before but he was taking tests. Bob Fant made a motion to approve
Sullins for the position and Buddy Curry seconded. Roll call: Bill Burnett, yes; Buddy Curry, yes; Bob
Fant, yes; Clay Dodson, yes.
Mayor Barron stated the USPO had requested to exercise their option to extend their contract with the
city for an additional 5 years. City Attorney Wright stated he wanted more time to check things out and
asked that discussion wart until next month.
Mayor Barron presented RESOLUTION 2009-09:A RESOLUTION ESTABLISHING FEES TO BE
CHARGED BY THE JOHNSON POLICE DEPARTMENT FOR CERTAIN SERVIES TO THE PUBLIC.
City Attorney Danny Wright read the resolution. Bob Fant made a motion to approve and Buddy Curry
seconded. All approved.
Mayor Barron presented ORDINANCE 2009-09: AN ORDINANCE LEVYING A TAX ON THE REAL
AND PERSONAL PROPERTY WITH THE CITY OF JOHNSON, ARKANSAS, FOR THE YEAR 2009,
FILING THE RATE AT 5.0 MILS, AND CERTIFYING THE SAME TO THE COUNTY CLERK OF
WASHINGTON COUNTY, ARKANSAS. Mayor Barron asked for a motion to read this ordinance by title
only. Bob Fant made a motion to read the ordinance by title only and was seconded by Buddy Curry.
Roll call: Bill Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Clay Dodson, yes. City Attorney Wright read
the ordinance by title only. Mayor Barron asked for a motion to approve the first reading. Buddy Curry
made a motion to approve the first reading and Bob Fant seconded. Roll call: Bill Burnett, yes; Buddy
Curry, yes; Bob Fant, yes; Clay Dodson, yes. Mayor Barron asked for a motion to suspend the rules and
continue on to the second reading by title only. Buddy Curry made a motion to continue to the second
reading by title only and was seconded by Clay Dodson. Roll call: Biil Burnett, yes; Buddy Curry, yes;
Bob Fant, yes; Clay Dodson, yes. City Attorney Wright read the ordinance by title only. Mayor Barron
asked for a motion to approve the second reading. Bob Fant made a motion to approve the second
reading and Clay Dodson seconded. Roll call: Bill Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Clay
Dodson, yes. Mayor Barron asked for a motion to suspend the rules and continue on to the third reading
by title only. Buddy Curry made a motion to continue to the third reading by title only and was seconded
by Clay Dodson. Roll call: Bill Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Clay Dodson, yes. City
Attorney Wright read the ordinance by title only. Mayor Barron asked for a motion to approve the third
reading. Bob Fant made a motion to approve the third reading and Clay Dodson seconded. Roll call: Bill
Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Clay Dodson, yes. ORDINANCE 2009-09 was approved.
Mayor Barron asked for a motion to pay the bills from the General Fund, Street Fund, Act 988 Fund and
Court Automation Fund that the council had reviewed. Bob Fant made a motion to pay the bills and
Buddy Curry seconded. All approved.
Mayor Barron asked for a motion to adjourn which was made by Bob Fant and seconded by Buddy Curry.
All approved and the meeting was adjourned at 7:54 PM.
