Mayor Lonnie Barren called the hearing to order at 5:35 pm at the Johnson Volunteer Fire
Department.
A PUBLIC HEARING ON THE DETACHMENT OF TERRITORY (99 AC, M/L) FROM THE CITY
OF JOHNSON AND ANNEXING SAID TERRITORY INTO THE CITY OF FAYETTEVILLE
PURSUANT TO A.C.A. —14-40-2101 AND FAYETTEVILLE ORDINANCE NO. 5317.
No members of the public were present and no comments were made.

Mayor Lonnie Barron called the meeting to order at 6:00 pm at the Johnson Volunteer Fire
Department.
Present were Aldermen Melissia Tomlinson, Bill Burnett, Buddy Curry, Tom Bramlett, Bob Fant
and Clay Dodson. Also present were Recorder/Treasurer Jennifer Allen, City Attorney Danny
Wright, Police Chief Vernon Sisemore, Fire Chief Matt Mills, Street Superintendent Randy
Birchfield and Building Official Paul Sullins.
Mayor Barron asked for a motion to approve the minutes of the May 11, 2010 council meeting.
Tom Bramlett made a motion to approve the minutes with this correction and Buddy Curry
seconded. All approved.
Department Head Reports:
Police Chief Vernon Sisemore stated 23 cases opened and 15 of those closed. Chief Sisemore
stated there have been some vehicle break-ins in Clear Creek, but it is a private community.
Chief Sisemore stated the officers have been using vacation and comp time.
Fire Chief Matt Mills stated there had been 24 calls for service and the firefighters were
continuing driver training and anticipating the engine 62 pump repair. Buddy Curry made a
motion to send the engine to get it fixed and Tom Bramlett seconded. All approved. Mayor
Barron told Chief Mills to take engine 62 to Springfield to have it fixed and gave the go ahead to
spend the $10,000.00 equipment grant to outfit it.
Street Superintendent Randy Birchfield stated the department has received some donated fill
dirt and is checking on bids to build a pad for the gravel. Birchfield stated the department has
been cleaning up flood damage all over town. Birchfield stated John Deere in Missouri
interested in purchasing the flail mower for $2,500.00 that is no longer used and asked the
council for permission to sell it. Bob Fant made a motion to approve the sale and Melissia
Tomlinson seconded. All approved. Chief Mills stated he had written a letter to Mayor Barron
stating that by cleaning the debris out from under the low water bridge the Street Department
probably saved a young boy from getting hung up under the bridge and drowning. Mills stated
he shot straight through and that is what saved him.
Building Official Paul Sullins stated he had 8 hours of continuing education.
Recorder/Treasurer Jennifer Allen the city's financial state has improved as the city has
received $104,000 property tax for the general fund and $11,500 the street fund in May. Allen
stated the city has also received $60,500 in city sales tax for April, which is a great increase
over the $32,700 for March.
City Attorney Danny Wright asked the council members to carefully read over the copies of the
water and sewer contract with Fayetteville they had received. Wright stated he has received a
letter from Kit Williams and there is a problem with exhibit c - it has been changed to say that
we will procure the north easement and it looks like they want us to give them our property
purchased from McClinton. Wright stated the first meeting they asked us to assist in
procurement of right of way; resolution in March says we will "cooperate"; they did not like it so
in April they changed "cooperate" to "procure" north side of right of way west of McGuire to 112.
Discussion was had. Bob Fant stated we should let Wright negotiate and tell them they can
have the $68,000 property but they have to buy their own right of way.
Mayor Barron stated the trail committee is still trying to get money from the Walton Family
Foundation for construction.
Mayor Barron stated there has been some trouble with the trash haulers (Roll Off) - with 60
days notice we can re-bid, so in October he would like to give notice and make any change at
the first of the year.
Mayor Barron stated he was encouraged on Johnson Road for the first time in a long time -
trying to get it done as soon as possible.
Mayor Barron stated he has not heard anything from Allen Canning regarding the donation of
the triangle of property between Hewitt and Ball off Main to the city.

Mayor Barron presented ORDINANCE 2010-02: AN ORDINANCE AMENDING ORDINANCE
NO. 01-07, ALSO KNOWN AS SECTION 7.24.01 OF TITLE 7 OF THE JOHNSON MUNICIPAL
CODE AUTHORIZING THE SALE OF FIREWORKS, ESTABLISHING A PERMIT PROCESS
AND FEE FOR THE SALE OF FIREWORKS, REGULATING THE SALE OF FIREWORKS,
DECLARING AN EMERGENCY TO EXIST AND FOR OTHER PURPOSES. Mayor Barron
asked for a motion to read the ordinance by title only. Bob Fant made a motion to read the
ordinance by title only and Tom Bramlett seconded. Roll call: Melissia Tomlinson, yes; Bill
Burnett, yes; Buddy Curry, yes; Tom Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. City
Attorney Danny Wright read the ordinance by title only. Mayor Barron asked for a motion to
approve this first reading. Tom Bramlett made a motion to approve this first reading and Buddy
Curry seconded. Roll call: Melissia Tomlinson, yes; Bill Burnett, yes; Buddy Curry, yes; Tom
Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. Mayor Barron asked for a motion to suspend
the rules and continue on to the second reading by title only. Buddy Curry made a motion to
suspend the rules and continue to the second reading by title only and was seconded by Tom
Bramlett. Roll call: Meiissia Tomlinson, yes; Bill Burnett, yes; Buddy Curry, yes; Tom Bramlett,
yes; Bob Fant, yes; Clay Dodson, yes. City Attorney Wright read the ordinance by title only.

Barren asked for a motion to suspend the rules and continue on to the third reading by title
only. Tom Bramlett made a motion to suspend the rules and continue to the third reading by
title only and was seconded by Buddy Curry. Roll call: Meiissia Tomlinson, yes; Bill Burnett, yes;
Buddy Curry, yes; Tom Bramlett, yes; Bob Fant, yes; Clay Dodson, yes. City Attorney Wright
read the ordinance by title only. Mayor Barren asked for a motion to approve this third reading.
Bob Fant made a motion to approve the third reading and Buddy Curry seconded. Roll call;

yes; Bob Fant, yes; Clay Dodson, yes. Mayor Barren asked City Attorney Danny Wright to read
the Emergency Clause. City Attorney Wright read the emergency clause and Mayor Barron
asked for a motion to approve it. Bob Fant made a motion to approve the emergency clause

2010-02 was approved
Mayor Barron stated Chief Sisemore and l_t. Taylor went with him to talk with Autumn Bynum,
the woman who owns the overgrown property across from City Hall. Mayor Barron stated
Bynum offered to sell the property to the city for $250,000.00. Buddy Curry stated we are out of
money right now due to future expenditures. Mayor Barron stated that Daisy Mayes passed
away last week (her house is directly east of city hall). Mayor Barron stated he has talked with
her daughter in the past and she has agreed to let the city have the right of first refusal when
she is ready to sell.
R/T Jennifer Allen invited everyone to the First Security Bank picnic Wednesday at noon in the
park.
Mayor Barron asked for a motion to pay the bills from the General Fund, Street Fund, Act 988
Fund, Warrant Service Fund and Court Automation Fund that the council had reviewed. Bob
Fant made a motion to pay the bills and Tom Bramlett seconded. All approved.
Mayor Barron asked for a motion to adjourn which was made by Buddy Curry and seconded by
Bob Fant. All approved and the meeting was adjourned at 7:16 PM.
