JOHNSON CITY COUNCIL
MEETING MINUTES
October 12, 2010


Mayor Lonnie Barron called the meeting to order at 6:00 pm
Present were Aldermen Melissia Tomlinson, Bill Burnett, Buddy Curry, Tom Bramlett, Bob Fant
and Clay Dodson. Also present were Recorder/Treasurer Jennifer Allen, City Attorney Danny
Wright, Police Chief Vernon Sisemore, Fire Chief Matt Mills and Building Official Paul Sullins.
Street Superintendent Randy Birchfield was absent
Mayor Barron thanked everyone for their support during his illness. Mayor Barron expressed the
City's sadness at Assistant Fire Chief and Fire Marshall Herb Beitel's passing; the service was
outstanding.
Mayor Barron asked for a motion to approve the minutes of the September 14, 2010 council
meeting. Bob Fant made a motion to approve the minutes and Clay Dodson seconded. All
approved.
Department Head Reports:
Police Chief Vernon Sisemore stated 12 new cases were opened and 11 of those closed. Chief
Sisemore stated the city has been inundated with fly by night door to door sales people, many of
which are unsavory people and he would like to look at changing regulations to give the city
more control over door-to-door sales to stop people from using it to case people's homes.
Mayor Barron stated they have to have business license. Chief Sisemore stated one group was
told they needed to come before the council and they are a no show. Discussion was had.
Mayor Barron asked City Attorney Danny Wright to look into what we can do. Chief Sisemore
stated he was contacted by Rep. Jon Woods regarding a grant that is only good for a radio
trunking system and that is not something we need.
Fire Chief Matt Mills thanked the city on behalf of the department for their support on the loss of
Assistant Fire Chief Herb Beitel; the service was a fitting tribute. Chief Mills stated they were still
moving on and doing their job Chief Mills stated he would be going to Little Rock on Monday to
pick up an equipment grant check for $15,000.00. Buddy Curry asked if the city could rename
the fire department building the Herb Beitel Building. City Attorney Danny Wright stated the city
doesn't own the building and therefore cannot name it. Chief Mills stated he thought it was a
good idea and he would talk to the fire board.
Street Superintendent Randy Birchfield was not present. Mayor Barron stated the department
was trying to catch up on some road patching, mowing and cleaning up. Mayor Barron stated
they had put in some new drainage down by Mourdour"s Pizza and the owner of the property
would pay for it. Mayor Barron also stated they had been working on clearing the ditches on Cris
Hollow Road.
Building Official Paul Sullins stated he had been working on with city engineer on flood plain and
storm management. Mayor Barron stated Sullins had passed his commercial electrical exam.
Recorder/Treasurer Jennifer Allen stated city's financial picture was improved today by the
receipt of $97,573.77 in Property Taxes, $9,678.94 of which will go to the Street Department.
Allen stated in the past the bulk of the property taxes has been received in November and was
very pleased to have gotten it in earlier. Allen stated the 5-year note for the land purchase will
be paid off in November.
City Attorney Danny Wright stated the appeal had been dismissed. Wright stated on January 1,
2012 our court will be run by Judge Ludwig and paid by the state. Wright stated signs are good
for the court to remain n Johnson with Ludwig coming here to officiate. Wright stated the Green
River Ordinance which prohibited door to door sales so the best we can right now do is make
them get a business license, possibly get no solicitation stickers; he said he's check with
Springdale about their no Knock list. Wright stated he had made the changes requested by the
committee to the Solid Waste Contract and each Alderman had a copy of it to look at before it is
discussed later in the meeting.
Mayor Barren stated Mayor Doug Sprouse said they would try to bid the Johnson Road project
in late December or early January.
Mayor Barren stated they are ready to start getting property in the right of way and then let it out
for bid.
Mayor Barren stated the Washington County Quorum Court has made proposals to cut the
amount of sales tax paid to cities. After discussion at the meeting and an eloquent speech by
Doug Sprouse, the Court decided to leave it as is for now, but will probably make cuts next year,

Mayor Barren presented ORDINANCE 2010-07: AN ORDINANCE LEVYING A TAX ON THE
REAL AND PERSONAL PROPERTY WITH THE CITY OF JOHNSON, ARKANSAS, FOR THE
YEAR 2009, FILING THE RATE AT 5.0 MILS, AND CERTIFYING THE SAME TO THE
COUNTY CLERK OF WASHINGTON COUNTY, ARKANSAS, Mayor Barren asked for a
motion to read this ordinance by title only. Bob Fant made a motion to read the ordinance by
title only and was seconded by Tom Bramlett. Roll call: Melissia Tomlinson, yes; Bill Burnett,
yes; Buddy Curry, yes; Bob Fant, yes; Clay Dodson, yes. City Attorney Wright read the
ordinance by title only. Mayor Barren asked for a motion to approve the first reading. Bob Fant
made a motion to approve the first reading and Clay Dodson seconded. Roll call: Melissia
Tomlinson, yes; Bill Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Clay Dodson, yes. Mayor
Barron asked for a motion to suspend the rules and continue on to the second reading by title
only. Buddy Curry made a motion to continue to the second reading by title only and was
seconded by Tom Bramlett. Roll call: Melissia Tomlinson, yes; Bill Burnett, yes; Buddy Curry,
yes; Bob Fant, yes; Clay Dodson, yes. City Attorney Wright read the ordinance by title only.

approve the second reading and Clay Dodson seconded. Roll call: Melissia Tomlinson, yes; Bill
Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Clay Dodson, yes. Mayor Barron asked fora
motion to suspend the rules and continue on to the third reading by title only. Buddy Curry made
a motion to continue to the third reading by title only and was seconded by Tom Bramlett. Roll
call: Melissia Tomlinson, yes; Bill Burnett, yes; Buddy Curry, yes; Bob Fant, yes; Clay Dodson,
yes. City Attorney Wright read the ordinance by title only. Mayor Barron asked for a motion to
approve the third reading. Bob Fant made a motion to approve the third reading and Clay
Dodson seconded. Roll call: Melissia Tomlinson, yes; Bill Burnett, yes; Buddy Curry, yes; Bob
Fant, yes; Clay Dodson, yes. ORDINANCE 2010-07 was approved.
Mayor Barron presented RESOLUTION 2010-08: A RESOLUTION SUPPORTING
AMENDMENTS TO THE CONSTITUTION OF THE STATE OF ARKANSAS. City Attorney
stated the ARML had asked that we pass this resolution in support of two questions on the
November ballot; lenders and caps on interest rates antigovernment capacity for financing
alternatives to attract big business to the state. City Attorney Wright read the resolution by title
and Bob Fant made a motion to approve, Buddy Curry seconded. All approved.
Mayor Barren opened discussion of the new Solid Waste Contract the City has put together to
make sure all of the City's needs are being met to our satisfaction. City Attorney Danny Wright
went over the contract he had drawn up and discussion was had. Representatives from three
local trash companies Roll-Off, Waste Management and Trash Away were present and given
time to talk about what they would do if they got the contract. Bob Fant made a motion to
approve the contract with the three changes made during the discussion and let it go out for bid.
Tom Bramlett seconded and all approved. Wright will make the corrections to the contract and
make them available through City Hall and bids will be cut off November 1, 2010.
Mayor Barron recognized John Davidson and Brain Fowler of Fowler Media who presented their
idea fora digital billboard to be located in Johnson. Davidson explained that this would be state
of the art and would require an addition to our sign ordinance. Discussion was had. Mayor
Barron stated Fowler Media is based in Johnson.
Mayor Barron turned the floor over to City Engineer Steve Hesse who showed the council option
4 for the reconfiguration of the wall/hillside in front of PD parking lot. After discussion, Bob Fant
made a motion to put this option out for bid with the inclusion of the language to be able to reject
any and all bids and was seconded by Buddy Curry. All approved.
Mayor Barron asked for a motion to pay the bills from the General Fund, Street Fund, Act 988
Fund, Warrant Service Fund and Court Automation Fund that the council had reviewed. Bob
Fant made a motion to pay the bills and Buddy Curry seconded. Al! approved.
Mayor Barron asked for a motion to adjourn which was made by BudcfyCurry and seconded by
Bob Fant. All approved and the meeting was adjourned at 8:10 PM.
