CITY COUNCIL MEETING
SEPTEMBER 14, 2010


The meeting was called to order at 6:00 p.m. by Jennifer Allen, acting mayor. Those present were
Police Chief Vemon Sisemore, Recorder/Treasurer (acting Mayor) Jennifer Allen, City Attorney Danny
Wright, Street Superintendent Randy Birchfield, Building Official Paul Sullins, Fire Chief Matt Mills,
Aldermen Bill Burnett, Buddy Curry, Tom Bramlett, Bob Fant and Clay Dodson. Melissia Tomlinson
was absent. During the discussion of the minutes from the August meeting Bob Fant announced that
there was one typo but he couldn't recall it at the time, so the minutes were accepted as presented by
motion of Bob Fant, second by Buddy Curry and unanimous vote.
DEPARTMENT HEAD REPORTS:
POLICE DEPARTMENT: There were 30 cases opened and 19 closed. There were 70 calls to
service. On September 25, 2010 there would be a DEA dropoff for old prescription drugs.
FIRE DEPARTMENT: They had 19 calls; held a 40 hour First Responded Course; sent a
letter to the ISO that had been requested; and have been working on some inhouse maintenance on
trucks. One fire fighter is still ill.
STREET DEPARTMENT: Fall clean-up is in progress with 2 dumpsters; they are cleaning a
fence near the fire department; working on the rock wall and other drainage issues.
BUILDING OFFICIAL: Permits are still down and all inspections are on schedule.
RECORDER/TREASURER: Expenses were up this month; reported on information received
from the municipal league regarding getting the fire department vehicles on the city insurance.
Suggested that the matter remain as it is for the time being.
CITY ATTORNEY: The south Johnson matter is now concluded. New city limit signs are up
and there is now a contract with the City of Fayetteville for water service south of Clear Creek. There
are four public defender's cases in Springdale court and one appeal to circuit court that has an Order to
Dismiss to be presented for signing; explained that the Municipal Leagae is not an insurance company
so their requirements would be a little different and explained some of the liability issues that the fire
department might be faced with.
MAYOR'S REPORT: Proposed to council that a sanitation contract with Waste Management
might be considered, since the current Roll-Off contract will soon expire, and recommendations be
made. Buddy Curry, Randy BIrchfield and Bob Fant will form a committee to investigate this matter.
Jennifer announced that a grant applied for had been turned down; that the rental house is now empty
and the city is exploring uses for the building. On Wednesday, September 22, there,will be a surprise
party for Millye Pollock's 91st birthday.
Steve Hesse was present for discussion of repairing the wall in front of the police department
office" and the parking lot. He presented bids and information. After discussion on how to solve
various problems, how much work the city could do with employees, sidewalk and drainage issues,
Bob Fant moved to accept the Fochtman Enterprises bid; Buddy Curry seconded and the motion passed
unanimously.
ORDINANCE 2010-06: Subject: Appointment of City Attorney. This is the second reading.
The first reading was at the August meeting.
Buddy Curry made motion for the second reading of the ordinance by title only; Tom Bramiett
seconded. Yes votes by roll call: Bill Burnett, Buddy Curry, Tom Bramiett, Bob Fant and Clay
Dodson. Melissia Tomlinson was not present.
Second reading by City Attorney by title only.
Bob Fant moved to accept the reading; Clay Dodson seconded; roll call yes votes: Bill Burnett,
Buddy Curry, Tom Bramiett, Bob Fant and Clay Dodson. Melissia Tomlinson was not present
Tom Bramiett moved to suspend the rules and continue to third reading; Buddy Curry seconded;
roll call yes votes: Bill Burnett, Buddy Curry, Tom Bramiett, Bob Fant, Clay Dodson. Melissia
Tomlinson was not present.
Third reading by City Attorney by title only.
Buddy Curry moved to accept the third reading of the ordinance; Tom Bramiett second; roll
call yes votes: Bill Burnett, Buddy Curry, Tom Bramiett, Bob Fant and Clay Dodson. Melissia
Tomlinson was not present.
The ordinance is approved.
Tom Bramiett made a motion to pay bills; Bob Fant seconded; motion carried unanimously
Buddy Curry made motion to adjourn seconded by Clay Dodson; motion carried unanimously.
The meeting was adjourned at 6:45 p.m.
