MEETING MINUTES
CITY HALL
January 8, 2013
Mayor Buddy Curry called the meeting to order at 6:00 pm.
Present were Aldermen Richard McMullen, Bill Burnett, Tom Bramlett and Bob Fant. Also present
were Recorder/Treasurer Jennifer Allen, City Attorney Danny Wright, Police Chief Vernon Sisemore,
Asst. Fire Chief Todd Witzigman, Street Superintendent Randy Birchfield, and Maintenance Specialist
Clay Wilson. Aldermen Dan Cross and Jim Shankle were absent.
Mayor Curry amended the agenda to include Resolution 2013-02 following Ordinance 2013-02.
Mayor Curry stated that to continue with the agenda, the Council need to be sworn in first. Mayor
Curry stated the meeting would proceed to the department head reports while waiting for the judge
to arrive for the swearing in.
Department Head Reports:
Police Chief Vernon Sisemore stated 12 new cases were opened, 8 closed. Chief Sisemore stated
there were 378 criminal cases for 2012 and 1,376 calls for service.
Asst. Fire Chief Todd Witzigman stated the department received 26 calls for service, 11 were EMS.
Witzigman stated the department conducted fire extinguisher training for employees at the Towne
Place Suits.
Street Superintendent Randy Birchfield stated the department has been working on general
maintenance. Birchfield stated the trail project goes all the way to the cell tower on the east side
now and progress on the road has slowed due to cold and wet weather.
Maintenance Specialist Clay Wilson stated there were no new building permits this month, but he
had done 33 inspections. Wilson stated he will continue studying for his ICC Residential Inspector
License.
Judge Jeff Harper arrived and Mayor Curry suspended the department head reports to return to the
top of the agenda. Judge Harper swore in Richard McMullen, Bill Burnett, Tom Bramlett and Bob Fant
for their 2 year terms as Aldermen.
Mayor Curry presented RESOLUTION 2012-01: A RESOLUTION CONFIRMING APPOINTMENTS OF
JUDGE JEFF HARPER OF DEPUTY COURT CLERKS. Motion to approve the resolution was made by Tom
Bramlett and seconded by Richard McMullen. All approved. Judge Harper swore in Rachel Duck as
the Court Clerk.
Mayor Curry asked for a motion to approve the minutes of the December 11, 2012 council meeting.
Bob Fant made a motion to approve the minutes as written and was seconded by Richard McMullen.
All approved.
Mayor Curry asked for a motion to approve the minutes of the December 20, 2012 special council
meeting. Bob Fant made a motion to approve the minutes as written and was seconded by Richard
McMullen. All approved.
Mayor Curry continued with the department head reports.
John Taylor stated the Econ Development Committee met today and they are following up on any
and all leads. Taylor stated Melissa Posinski was added to the committee.
Recorder/Treasurer Jennifer Allen stated she was sworn in on January 2, 2013 by Judge Harper with
Mayor Curry present. Allen stated $50,000.00 has been transferred to the LOPF1 fund to pay for
police officer retirement through June; LOPFI account is interest bearing so there is no revenue lost
by making this transfer. Allen stated the 2012 statements of financial interest are due in her office by
January 31, 2013.
City Attorney Danny Wright stated he has finished reviewing the codification book and is drafting a
letter to the Mayor. Wright stated there will be an ordinance for electronic funds transfer tonight
and for updating the building codes. Wright stated when it comes to the codes there are many
lawyers and many levels involved.
Mayor Curry stated he is waiting on the $50,000.00 General Improvement Project check from the
state. Mayor Curry stated he has been reviewing and updating all of the job descriptions for all city
and court positions. Mayor Curry stated he had included in the packets a copy of the state of the city
letter he has written.
Unfinished Business:
Mayor Curry Presented ORDINANCE 2012-13: AN ORDINANCE TO RENAME A PORTION OF GREAT
HOUSE SPRINGS ROAD AND TO NAME A NEW STREET WHICH EXTENDS THE RENAMED PORTION OF
GREAT HOUSE SPRINGS ROAD AND RUNS EASTERLY TO CONNECT WITH JOHNSON ROAD NORTH OF
THE RAILROAD TACKS AND SANDY CREEK; AND OTHER MATTERS RELATED THERETO. Mayor Curry
asked for a motion to read the ordinance by title only. Motion was made by Bob Fant and seconded
by Richard McMullen. Roll call: Richard McMullen, yes; Bill Burnett, yes; Tom Bramlett, yes; Bob Fant,
yes. City Attorney Wright read the title. Mayor Curry asked for a motion to approve this second
reading. Motion to approve was made by Richard McMullen and seconded by Bob Fant. Roll call:
Richard McMullen, yes; Bill Burnett, yes; Tom Bramlett; Bob Fant, yes.
New Business:
Mayor Curry stated that per Legislative Audit, the report for 2011 must be discussed and approved
by the council. Mayor Curry stated that 2011 was clean audit with absolutely no dings and the
supervisor stated that they don't see that very often in other towns. Mayor Curry thanked R/T Allen
for doing such a good job. Mayor Curry asked for a motion to approve the report which was made by
Tom Bramlett and seconded by Bob Fant. All approved.
Mayor Curry presented ORDINANCE 2013-01: AN ORDINANCE AUTHORIZING PAYMENT OF CITY
FUNDS FOR SPECIFIED PURPOSES AS PROVIDED IN ACA 14-59-105 BY ELECTRONIC FUNDS TRANSFER
AND FOR OTHER PURPOSES. Mayor Curry asked for a motion to read the ordinance by title only. Bob
Fant made a motion to read the ordinance by title only and waive the second and third readings and
was seconded by Tom Bramlett. Roll call: Richard McMullen, yes; Bill Burnett, yes; Tom Bramlett; Bob
Fant, yes. ORDINANCE 2013-01 was approved,
Mayor Curry presented ORDINANCE 2013-02: AN ORDINANCE ADOPTING VARIOUS CODES WHICH
REGULATE ALL CONSTRUCTION OF NEW BUILDINGS, AND ADDITIONS AND MODIFICATION OF
EXISTING BUILDINGS AND OTHER RELATED MATTERS. Mayor Curry asked for a motion to read the
ordinance by title only. Motion was made by Richard McMullen and seconded by Bob Fant. Roll call:
Richard McMullen, yes; Bill Burnett, yes; Torn Bramlett, yes; Bob Fant, yes. City Attorney Wright read
the title. Mayor Curry asked for a motion to approve this first reading. McMullen asked why this was
being done. City Attorney Wright stated that some of these are new versions of old codes and in
order to adopt them notice must be run in the newspaper and we have proof of that publication.
Motion to approve was made by Bob Fant and seconded by Tom Bramlett. Roll call: Richard
McMullen, yes; Bill Burnett, yes; Tom Bramlett; Bob Fant, yes.
Mayor Curry presented RESOLUTION 2013-02: A RESOLUTION AUTHORIZING CERTAIN CITY
OFFICIALS TO EXECUTE CHECKS AND DRAFTS ON SPECIFIED ACCOUNTS OF THE CITY OF JOHNSON
AND THE JOHNSON POLICE DEPARTMENT. R/T Jennifer Allen stated this resolution removes Denny
Upton and replaces him with Rachel Duck, the new court clerk. Mayor Curry asked for a motion to
approve the resolution which was made by Tom Bramlett and seconded by Bill Burnett. All approved.
Mayor Curry asked fora motion to pay the bills from the General Fund, Street Fund, Act 988 Fund,
Warrant Service Fund and Court Automation Fund that the council had reviewed. Bob Fant made a
motion to pay the bills and Bill Burnett seconded. All approved.
Mayor Curry asked for a motion to adjourn which was made by Bob Fant and seconded by Tom
Bramlett. All approved and the meeting was adjourned at 6:32 pm.
