MEETING MINUTES

February 11, 2014
Mayor Buddy Curry called the meeting to order at 6:01 pm.
Present were Aldermen Richard McMullen, Bill Burnett, Dan Cross, Tom Bramlett, Bob
Fant and Jim Shankle. Also present were Recorder/Treasurer Jennifer Allen, City
Attorney Danny Wright, Police Chief Vernon Sisemore, Fire Marshall Todd Witzigman,
Maintenance Superintendent Gerry Russell and Building Official/Maintenance Specialist
Clay Wilson.
Mayor Curry asked fora motion to approve the minutes of the January 14, 2014 council
meeting. Bob Fant made a motion to approve the minutes and was seconded by Bill
Burnett. All approved.
Department Head Reports:
Police Chief Vernon Sisemore stated that 44 new cases were opened and 41 closed, 6
wrecks. Chief Sisemore said they are looking for a new officer to replace the one who
quit in December.
Fire Marshall Todd Witzigman January had been a very busy month with 29 calls for
service including 3 grass fires and 1 structure fire. Witzigman stated It has been very dry
and the area is still under a burn ban.
Maintenance Superintendent Gerry Russell stated the his department worked many
long hours in the bad weather. Russell stated they have been unclogging culverts and
have helped Signal Tek remove the 48th Street light.
Building Official/Maintenance Specialist Clay Wilson stated 1 building permit and 9
mechanical permits were issued. Wilson stated he did 19 inspections and is finished
outfitting the new Tahoe. Wilson stated he wanted to thank the fire department for
their quick response and the excellent care they took of his dad when he had a heart
attack last month.
Recorder/Treasurer Jennifer Allen stated that $30,000 was transferred to the LOPFI
account to pay for the police officers' retirement through May. Allen stated the City has
received the $25,000.00 general improvement grant for equipment to be used for a
new back hoe. Allen reminded each Alderman to file their 2013 Statement of Financial
Interest form that is required by the State Ethics Commission to be completed annually.
Allen stated she attended the AMI Winter Conference in Rogers. Allen stated the city
has spent $21,783 of the $50,000.00 received for our General Improvement Project.
City Attorney Danny Wright stated there was not a settlement in the Bynum lawsuit and
he has filed for a second time to dismiss us from the case letting them know they need
to pay the fees. Wright complemented the new video system put in place by the PD. He
said the clarity of both audio and video was outstanding. Wright stated his annual
report is available for review at City Hall.
Mayor Curry stated the trail opening is scheduled for April 12, 2014.
Mayor Curry said while he was a the AMI Conference he was told our street aid
projects have been approved up to $250,000.00. Mayor Curry stated that anything over
that amount would either have to be paid by the city or projects would have to be cut.
Mayor Curry asked for council to authorize him to commit up to $50,000.00 over the
$250,000.00 being offered by the state to keep the process moving forward if the
additional funds were needed. Discussion ensued. Bob Fant made a motion to authorize
Mayor Curry to spend up to $50,000.00 to continue the project if the additional funds
were required and was seconded by Dan Cross. All approved.
Mayor Curry stated the NWA Economic Development District gave the city a $25,000
grant for equipment; we budgeted $45,000.00 for new equipment in case this didn't
come through. Mayor Curry proposed purchasing a backhoe for $38,412.50, a Polaris
Ranger for $10,744.53 (giving the current mule to the Fire Department to outfit for
emergency use on the trail) and the purchase of a brush system for $5,426.45 to sweep
the streets, particularly after the winter we have had and all the chat that needs to be
removed. Allen stated that these items total $54,583.48, but by using the grant money
the actual cost to the city will be less than $30,000 leaving $15,000 in the budget for
any future needs. Discussion ensued. Dan Cross made a motion to approve the
proposed equipment package purchase and Bob Fant seconded. Concern was expressed
about there only being one vendor with the items needed and it was discussed. With a
motion and second on the floor, Mayor Curry asked for a vote and all approved.

Mayor Curry presented ORDINANCE 2014-01: AN ORDINANCE ESTABLISHING POLICY
FOR USE OF THE PEDESTRIAN/BIKE TRAILS WITHIN THE CITY OF JOHNSON AND
PROVIDING FOR A PENALTY FOR VIOLATION OF SUCH POLICY AND AMENDING THE
JOHNSON MUNICIPAL CODE BY ADDING CHAPTER 12.01 AND CHANGING THE NAME OF
TITLE 12. Mayor Curry asked fora motion to read ORDINANCE 2014-01 by title only.
Motion was made by Tom Bramlett and seconded by Bob Fant. Roll call: Richard
McMullen, yes; Bill Burnett, yes; Dan Cross, yes; Tom Bramlett, yes; Bob Fant, yes; Jim
Shankle, yes. City Attorney Danny Wright read the ordinance by title only. Mayor Curry
asked for a motion to approve the reading by title only. Motion was made by Bob Fant
and seconded by Jim Shankle. Roll call: Richard McMuIlen, yes; Bill Burnett, yes; Dan
Cross, yes; Tom Bramlett, yes; Bob Fant, yes; Jim Shankle, yes.
Mayor Curry asked for a motion to pay the bills from the General Fund, Street Fund, Act
988 Fund and Court Automation Fund that the council had reviewed. Tom Bramlett
made a motion to pay the bills and Dan Cross seconded. All approved.
Mayor Curry asked for a motion to adjourn which was made by Bob Fant and seconded
by Jim Shankle. All approved and the meeting was adjourned at 6:38 pm.
