CITY OF JOHNSON, WASHINGTON COUNTY, ARKANSAS

A RESOLUTION RATIFYING THE EXECUTION OF A REAL ESTATE CONTRACT AND EXCLUSIVE BUYER AGENCY AGREEMENT FOR THE PURCHASE OF REAL PROPERTY LOCATED AT 3305 MAIN DRIVE, JOHNSON, AR 72704 FOR THE CITY OF JOHNSON, ARKANSAS

            WHEREAS, following authorization provided by the City Council of its August 11th, 2020 City Council Meeting, the City of Johnson has entered into a Real Estate Contract and Exclusive Buyer Agency Agreement, attached hereto as Exhibit “A”, for the purchase of 3305 Main Drive, Johnson, AR, 72704; and

            WHEREAS, the Mayor and the City Council, after thorough consideration believe that it is in the best interest of the citizens of the City of Johnson to ratify the Real Estate Contract and Exclusive Buyer Agency Agreement.

            NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Johnson as follows:

            Section 1:  That the City Council hereby ratifies the Real Estate Contract and Exclusive Buyer Agency Agreement for the purchase of real property attached hereto as Exhibit “A”, with any changes deemed necessary and all further action which may be necessary in order to carry out and perform the purposes and intents of this Resolution and all actions taken by the Mayor in connection therewith are hereby approved.

A RESOLUTION AUTHORIZING THE MAYOR TO TERMINATE INTERLOCAL AGREEMENT BETWEEN THE CITY OF SPRINGDALE AND THE CITY OF JOHNSON, ARKANSAS

REGARDING JOHNSON ROAD/JOHNSON MILL BOULEVARD.

WHEREAS, on or about January 10, 2006, the City of Springdale and the City of Johnson entered into an Interlocal Agreement (“Agreement”) to develop a collector street which connects two (2) high priority corridors through the improvement of Johnson Road from Highway 412 in Springdale south to connect with Main Street to be known as the Johnson Road/ Main Street Improvement Project (“Project”); and

WHEREAS, Phase I of the Project consisted of the acquiring of right-of-way and initial construction improvements and has been performed and Phase II of the Project requires the maintenance of the entire length of the Project for a period of twenty (20) years; and

WHEREAS, in order to allow for the installation of continued improvements, the City of Springdale and the City of Johnson desire to terminate the Agreement in order to release Springdale from the management of the maintenance for the portion of the Project that lies in the municipal limits of Johnson and allow for the continued improvements to take place; and

WHEREAS, both cities have received assurances from ARDOT which manages the funding for the project that the Agreement was no longer needed and could be terminated; and

WHEREAS, the Johnson City Council desires to authorize the Mayor and the City Clerk-Treasurer to take all measures, including the execution of documents, to terminate the Agreement.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Johnson as follows:

Section 1: That the Mayor and City Clerk-Treasurer of the City of Johnson, Arkansas are hereby authorized to take all measures necessary, including the execution of any documents or instruments, to terminate the Interlocal Agreement between the City of Johnson and the City of Springdale regarding the construction and maintenance of Johnson Road/Johnson Mill Boulevard.

CITY OF JOHNSON, WASHINGTON COUNTY, ARKANSAS

A RESOLUTION APPROVING A MUTUAL AID AGREEMENT BETWEEN THE CITY OF JOHNSON FIRE DEPARTMENT AND THE CITY OF SPRINGDALE FIRE DEPARTMENT.

 

WHEREAS, the City of Johnson, Arkansas and the City of Springdale, Arkansas, believe that it is in their best interests to enter an agreement providing for mutual aid in certain circumstances as set forth in the attached Mutual Aid Agreement; and

WHEREAS, pursuant to authority authorized in the Interlocal Cooperation Act, the parties have prepared an informal agreement setting forth their respective duties, obligations and responsibilities with respect to mutual aid services within their respective jurisdictional boundaries.

NOW, THERFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JOHNSON AS FOLLOWS:

Section 1. That the Mutual Aid Agreement between the City of Johnson Fire Department, and the City of Springdale Fire Department is hereby ratified and approved as in the form, or substantially similar to the form, as attached.

Section 2. The Mayor, Fire Chief and City Clerk-Treasurer are hereby authorized and directed to execute the informal Mutual Aid Agreement on behalf of the City of Johnson, Arkansas, and to take any and all necessary action as may be required to fully completely implement the provisions of said Agreements.

CITY OF JOHNSON, WASHINGTON COUNTY, ARKANSAS

   A RESOLUTION EXPRESSING THE WILLINGNESS OF THE CITY OF JOHNSON TO APPLY FOR STBGP-A FUNDING FOR ACQUISITION OF RIGHT-OF-WAY AND RELOCATION OF FRANCHISE UTILITIES FOR GENE GEORGE BLVD FROM DON TYSON PARKWAY TO JOHNSON MILL ROAD.

           

WHEREAS, the Cities of Johnson and Springdale have received STP-A funding for the design of Gene George Blvd. widening from Don Tyson Parkway to Johnson Mill Boulevard; and

WHEREAS, using the procurement procedures required by State Law, the Cities have retained Engineering Services, Inc. to perform the project design; and

WHEREAS, project design has been completed and there is a need to purchase right-of-way and relocate utilities where necessary; and

WHEREAS, the City of Johnson is responsible for 30% of the 20% local match and the City of Springdale is responsible for 70% of the 20% local match:

CITY OF JOHNSON, WASHINGTON COUNTY, ARKANSAS

A RESOLUTION AUTHORIZING MEMBERSHIP AND PARTICIPATION IN THE NORTHWEST ARKANSAS RAZORBACK GREENWAY ALLIANCE.

WHEREAS, during the planning phase of the Northwest Arkansas Razorback Greenway, it was acknowledged that because of its unique regional characteristics, stewardship of the facility would require a non-traditional and uniquely cooperative approach to management and operations with integral involvement of all cities through which the Greenway traversed; and

WHEREAS, uniform and consistent guiding principles of quality for maintenance, operational standards, management, signage, public information, promotion, and future improvements were outlined in the “Northwest Arkansas Razorback Greenway Operations and Management Plan;” and

WHEREAS, the Plan, which was adopted by all cities in the corridor, included a commitment from each city to participate through membership in a regional committee with the purpose of jointly and cooperatively facilitating uniformity and consistency in the standards, operations, and management of the Greenway; and

WHEREAS, such joint cooperation is best achieved through the Interlocal Cooperation Act, codified at A.C.A. 25-20-101 et seq., through an agreement to create and participate in the Northwest Arkansas Razorback Greenway Alliance.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Johnson as follows:

Section 1.        That the Mayor be and is hereby authorized to execute the “Northwest Arkansas Razorback Greenway Alliance Agreement,” which is herewith approved and attached hereto.

Section 2.        That said Agreement shall only become operative and in effect upon approval of all cities involved (Fayetteville, Johnson, Springdale, Lowell, Rogers, Bentonville, and Bella Vista), and upon approval by the Arkansas Attorney General’s Office.

NOTICE TO DEFENDANTS

Protecting the health of all who enter our court, i.e. attorneys, court staff, and members of the public, it is our highest priority. Avoiding exposure to infected individuals is key to stopping the spread of COVID-19. As we plan for the return to in-person proceedings, it will be critical to minimize the potential for exposure to the extent possible. To accomplish this, the Department of Health and the Supreme Court of Arkansas recommends the following:

  1. Screen to identify symptomatic individuals and those who have been exposed to others with COVID-19;
  2. Taking the temperature of individuals entering the courthouse; and,
  3. Have individuals complete a brief questionnaire regarding symptoms and potential exposure.

The Court will be implementing recommended procedures for all persons to protect against exposure from asymptomatic people upon entering the courtroom by:

  1. Social distancing: maintaining a minimum of six feet (6') between people;
  2. Wearing a mask and gloves always; and,
  3. Defendants should only enter the courtroom alone (no significant other, child, or friend). The only exception that will be made is if it is a juvenile defendant, then we will allow one parent to accompany him/her.

Due to the unusual circumstances surrounding COVID-19, it is important for you to contact our office (479-521-3192) before your court date to verify your date and time has not changed. We will NOT mail you a Notice of New Court Date; it is your responsibility to follow-up. Also, on your court date, be prepared for longer wait times due to precautionary measures we are taking.

 CITY OF JOHNSON, WASHINGTON COUNTY, ARKANSAS 

A RESOLUTION ESTABLISHING TEMPORARY PROTOCOLS FOR PUBLIC MEETINGS DURING TIMES OF NATIONAL OR STATEWIDE EMERGENCY.

WHEREAS, on March 11, 2020, Arkansas Governor Asa Hutchinson issued an Executive Order to Declare a State of Emergency due to the outbreak of coronavirus disease 2019 (COVID-19) across the United States and in Arkansas;

WHEREAS, public schools and universities across the state have been closed due to this State of Emergency and further orders by Governor Hutchinson;

WHEREAS, the disease is known spread from person to person contact;

WHEREAS, public events, meetings, and gatherings have been cancelled throughout the state of Arkansas due to continued transmission of the disease throughout the state and the Arkansas Supreme Court has ordered that all in-person proceedings in Arkansas Courts are suspended;

WHEREAS, businesses throughout the state of Arkansas have closed or have employees working from home in order to limit the transmission of the disease;

WHEREAS, continued public events, meetings, and gatherings pose an immediate threat to the health, safety and welfare of the general public and the Governor has ordered that public gatherings, with limited exceptions, of more than ten (10) persons are prohibited;

WHEREAS, due to the nation-wide and state-wide emergencies that have been declared, the state mandated orders and the city’s authority under Arkansas law to use police powers to protect the health, safety and welfare of citizens and the general public, the City of Johnson must establish a protocol for the conduct of public meetings during times of such emergencies in order to safely and appropriately conduct public business while best adhering to the principals of the Arkansas Freedom of Information Act (“FOIA”) and Arkansas law; and

WHEREAS, such a protocol shall apply to the City Council, Planning Commission, Board of Zoning Adjustments and other public meetings involving the City of Johnson (“Public Meetings”) as required by the FOIA and Arkansas law.

            NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JOHNSON, ARKANSAS: 

  1. Public Meetings through electronic or virtual participation by city officials, city employees or the general public shall be allowed during a time of a nation-wide or state-wide emergency upon the order of the Mayor of Johnson.
  2. City Council members, Planning Commissioners, members of the Board of Zoning Adjustments may choose to be physically present or to attend any Public Meetings during this temporary period of time through a conference call or telephone or a computer device which allows an audio or video to be transmitted and recorded. Such electronic or virtual participate shall ensure that that an official can hear other official participants of the meeting and also be heard by other participants of the meeting. 
  1. Public hearings required by state law shall continue to be held in the City Council Chambers and the public may participate and offer comments through electronic or virtual participation. 
  1. For Public Meetings in which city officials, city employees or the general public are present, proper distancing guidelines as recommended by the Centers for Disease Control shall be observed, if necessary. 
  1. Public participation in Public Meetings shall be conducted through a virtual web conference application or publicly accessibly video stream and audio stream that will allow public participants to hear the discussion and make public comments at the appropriate times in the meeting. Public comments will also continue to be encouraged through email, US mail, or other forms of appropriate transmission to the City of Johnson.

The area health care providers and state agencies continue to work and coordinate efforts in screening, treating and containing the coronavirus (COVID-19) as questions continue to circulate in our community - from patients, media, employers, family and friends.
