AN ORDINANCE TO AMEND ORDINANCE NO. 159 TO REFLECT
THE CORRECT LEGAL DESCRIPTION FOR THE PROPERTY
DESCRIBED IN ORDINANCE NO. 159, AND ALSO PROPERTY
IDENTIFIED IN THE CITY OF JOHNSON
ZONING PETITION NO. 95-1 1, AND TO REPEAL
ORDINANCE NO. 166, IN IT'S ENTIRETY.
WHEREAS, the legal description described in Ordinance Number 159 and
Ordinance No. 166 were inaccurate and the City, at this time, has been provided with the
correct legal description of said property and
WHEREAS, the correct legal description is vitally needed to file the proper plat
with the Office of the Circuit Clerk of Washington County.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF JOHNSON,
ARKANSAS:
SECTION ONE: The zone classification of the following described property
changed from Agricultural 1 to Industrial
LAYMAN'S
DESCRIPTION: 5703 Hewitt.
LEGAL
DESCRIPTION: Part of the Southeast Quarter of the Northwest Quarter of Section
Twenty-two (22), in Township Seventeen (17) North of Range Thirty (30) West of the
5th Principal Meridian, described as follows, to-wit: Beginning at a point on the right of
way of the Frisco Railroad which is five hundred seventy-one and three-tenths (571.3)
feet South and two hundred five and six-tenths (205.6) feet West of the North East corner
of said fort}' acre tract, and running, thence South 81 degrees East one hundred sixty-four
(164) feet; thence South 9 degrees West sixteen (16) feet; thence South 55 degrees West
fifty-two and five-tenth (52.5) feet; thence South 17 degrees 20' West three hundred
twenty-eight (328) feet; thence North 77 degrees West one hundred fourteen (114) feet;
thence South 8 degrees 35' West one hundred (100) feet; thence in a Southeasterly
direction one hundred seventy-five (175) feet to a point which is sixty-two (62) feet East
of the Frisco Railroad right of way; thence West sixty-two (62) feet to said right of way;
thence in a Northeasterly direction along said railroad right of way six hundred fifty-nine
(659) feet to the place of beginning, containing one and six-tenths (1.6) acres, more or
less.

SECTION TWO: That the official Zoning Districts map of the City of Johnson, AR
is hereby amended to reflect the zoning change in Section One
above.
SECTION THREE: That the official zoning petition be amended to reflect the corrected
legal description as noted above.
SECTION FOUR: EMERGENCY CLAUSE: The City Council determines that an
emergency exists and this ordinance, being necessary for the
preservation of the health, safety, and welfare of the citizens of
Johnson, Arkansas shall be effective immediately upon its passage,
approval, publication, and recording of a certified copy thereof
with the Recorder of Washington County, Arkansas.
