Ordinance 1996-26

AN ORDINANCE REPEALING EXISTING ORDINANCE NO. 152 WHICH
REDUCED THE SALARY OF THE OFFICE OF RECORDER/TREASURER,
DECLARING AN EMERGENCY TO EXIST'AND FOR OTHER PURPOSES.
WHEREAS, the City Council for the City of Johnson, Arkansas
has determined that passage and adoption of Ordinance 152 violated
the provisions of A.C.A. 14-42-113 sfnce it dealt with the salary
of the Recorder-Treasurer during the term of her appointment which
expires December 31, 1996.
WHEREAS, following the passage of such Ordinance the salary
paid to Sherry Curtis and her successor was changed to $75.00 per
month.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE
CITY OF JOHNSON, ARKANSAS THAT ORDINANCE NO. 152 BEJ REPEALED IN ITS
ENTIRETY.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL FOR THE CITY OF
JOHNSON, ARKANSAS, THAT the Recorder-Treasurer is hereby directed
to calculate the amount which should have been paid to Sherry
Curtis and her successor as Recorder-Treasurer, reduce that amount
by the sums actually paid said Official and her successor, and pay
the difference (less appropriate withholdings which will be paid to
the proper authorities) to Sherry Curtis and her successor
respectively upon their execution and delivery to the City of an
appropriate release of claims involving this matter.
The City of Johnson hereby determines that an emergency
exists, and this ordinance is necessary for the efficient
administration of City business and to correct an egregious error
and this Ordinance shall be effective immediately upon its passage
and approval.
