Ordinance 1996-28

AN ORDINANCE PROVIDING FOR THE POSTING OF BYLAWS AND
ORDINANCES OF THE CITY OF JOHNSON, ARKANSAS, AND
DETERMINING FIVE (5) OF THE MOST PUBLIC PLACES IN
JOHNSON, ARKANSAS FOR THE PURPOSE OF POSTING ORDINANCES,
BYLAWS, AND NOTICES, AND DECLARING AN EMERGENCY TO EXIST.
WHEREAS, the City of Johnson is required by Arkansas Code
Annotated Section 14-55-206 to either publish or post written or
printed notice of any law or ordinance,
WHEREAS, there is no newspaper published in Johnson, Arkansas,
WHEREAS, the most effective way of notifying the citizens and
residents of Johnson of bylaws and ordinances of a general or
permanent nature is to post same in public places within the City
of Johnson.
WHEREAS, the City Council of Johnson, Arkansas is required to
designate five (5) of the most public places in Johnson, Arkansas,
which shall be utilized for the aforesaid posting, and
WHEREAS, the City Council needs to give specific guidelines
concerning the posting of bylaws and Ordinances
NOW, IT IS HEREBY DETERMINED AND ENACTED BY THE CITY COUNCIL
OF THE CITY OF JOHNSON, ARKANSAS,
SECTION 1: That all laws, bylaws, or ordinances of the City
of Johnson, Arkansas, hereinafter adopted or enacted shall be
posted in the five (5) hereinafter designated public places for a
period of not less than thirty (30) calendar days.
SECTION 2: Such posting, as aforesaid, shall occur with
seventy-two (72) hours of adoption or enactment, shall be done in
a manner which provides reasonable protection for the documents
against the elements, the posting should ensure that the full text

of 'the ordinance is visible to the public or that the full title
and first page of text is visible with written advice to the effect
that a complete copy of the entire text of the bylaw or ordinance
is available to the public at the office of the City
Recorder/Treasurer in City hall during regular office hours.

SECTION 3: That the official or employee of the City of
Johnson who posts each such law, bylaw or ordinance, and who later
removes each such law, bylaw or ordinance shall make a permanent
record of the date of posting, the date of removal, and the
locations where posted in a permanent Record to be maintained by
the City Recorder/Treasurer.
SECTION 4: That the most public places in Johnson, Arkansas
are hereby determined to be:
1) City Hall - South entrance
2) City Hall Bulletin Board
3) Post Office, Main and Wilkerson, Inside
4) Post Office, Main and Wilkerson, Bulletin Board
5) Convenience store at SE corner of Wilkerson and Main,
Bulletin Board
SECTION 5: That the posting of bylaws and ordinances whencompared
to the cost of publishing such bylaws and ordinances
should result in significant savings for the City and provide
greater notice to the public and therefore an emergency is hereby
declared to exist and it is determined that immediate passage and
implementation of this Ordinance is necessary for the preservation
of the public peace, health and safety of the citizens of Johnson
and therefore this Ordinance shall take effect and be in full force
and effect from and after its passage and approval.
