Ordinance 1997-07

ORDINANCE PROVIDING FOR THE APPOINTMENT OF A CITY

ATTORNEY FOR THE CITY OF JOHNSON, ARKANSAS; REPEALING ALL

OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT

HEREWITH; AND, FOR OTHER PURPOSES

WHEREAS, Arkansas Code Annotated Section 14-42-112 has been

interpreted to require Arkansas Cities of the Second Class and

Incorporated towns to hold elections for the position of Municipal

Attorney;

WHEREAS, Act 645 of 1997, became effective to amend Section

14-42-112 on August

1, 1997;

WHEREAS, the City of Johnson, Arkansas, has, since its

incorporation as a town, until November, 1996, appointed its

Municipal Attorneys as required by the needs of the Town/City;

WHEREAS, the Johnson City Council having considered the

benefits to the City of electing a Municipal Attorney and

considered the benefits to the City of appointing its Municipal

Attorney; and,

WHEREAS, the City Council of Johnson, Arkansas, has determined

that the best interest of the City and its citizens will be most

effectively served by the continued appointment of its Municipal

Attorney,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE

CITY OF JOHNSON, ARKANSAS, THAT,

1. The Municipal Attorney for the City of Johnson, Arkansas,

shall be appointed by the Mayor and approved by a majority of the
