Ordinance 1999-02

AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS
FOR THE CITY TO OBTAIN ONE TRACT AND AN EASEMENT FROM
GREEN COUNTRY NURSERY AND LANDSCAPING, INC., KEN H.
COLVIN AND GLORIA K. COLVIN, HUSBAND AND WIFE, AND ONE
TRACT AND AN EASEMENT FROM KENNETH H. COLVIN AND GLORIA
K. COLVIN, HUSBAND AND WIFE, FOR THE CLEAR CREEK BRIDGE
PROIECT AS REQUIRED BY THE ARKANSAS HIGHWAY AND
TRANSPORTATION DEPARTMENT; AND DECLARING AN EMERGENCY
TO EXIST.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JOHNSON,
ARKANSAS:
Section 1. That the City Council authorizes and directs the city attorney of the City of
Johnson, Arkansas to initiate legal action, in order to obtain the property known as Tract 1, and
IE, and Tract 2 and 2E, owned by Green Country Nursery and Landscaping, Inc., Ken H. Colvin
and Gloria K. Colvin, husband and wife, and Kenneth H. Colvin and Gloria K. Colvin, husband
and wife, respectfully, needed for the Clear Creek Bridge Project as required by the Arkansas
Highway and Transportation Department, in conjunction with the right of way and construction
of the bridge and its' approaches over Clear Creek, on the property described below;
See Exhibit "A" attached hereto and made a part hereof.
Section 2. The present one lane bridge over Clear Creek on Wilkerson Street has been
approved for replacement with monies from the State/Federal Government, the City of
Fayetteville and the City of Johnson. In order to meet bidding deadlines of the AHTD, it is
necessary that this Ordinance be passed and become effective as soon as possible. This will also
benefit the citizens of this City by moving the project ahead and securing the funding assistance.
Therefore an emergency is hereby declared to exist and this ordinance shall be and become
effective with its passage and approval.
