Ordinance 2002-06

AN ORDINANCE AMENDING ORDINANCE NO. 99-6, MODIFYING AND
UPDATING THE ZONING LAW OF THE CITY OF JOHNSON, ARKANSAS;
REPEALING ALL ORDINANCES ORPARTS OF ORDINANCES IN CONFLICT
HEREWITH; AND FOR OTHER PURPOSES AND DECLARING AN
EMERGENCY TO EXIST.
WHEREAS, the City Council of Johnson, Arkansas deems it necessary, from time to time to
clarify language, and to adjust it's adopted Zoning Ordinance for the purposes of promoting the
health, safety, and general welfare of the citizens of Johnson, Arkansas; and,
WHEREAS, the Johnson City Planning Commission has recommended amending Ordinance
No. 99-6, the same being the Zoning Ordinance of the City of Johnson, Arkansas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF JOHNSON,
ARKANSAS, IN REGULAR SESSION ASSEMBLED, as follows:
SECTION 1: Ordinance No. 99-6 of the City of Johnson, the same being the Zoning
Ordinance for the City of Johnson, is amended as hereinafter set forth.
SECTION 2: Ordinance No. 99-6, Section VI-Districts. Subsection 4, Permitted Uses by
Zoning District Table, found on Pages 17 and 18, (Permitted uses) is hereby amended as follows:
a) the "Eating Place, Interior Dining - No Drive-in Auto Service" row is hereby
amended with the letters "SP" being replaced with an "X" in the second column,
(\vhich is the C-l District column); and?
b) the "Eating Place Providing Auto Service" row is hereby amended by adding an "X"
in the second column (which was blank on this row) which is the C-l District column.
These corrections bring certain points into agreement with Section VI, Districts. Character and
Description, Sub-section 3B, Commercial Districts Number 1, which is the description for C-l
districts found on page 16 of Ordinance 99-6.
SECTION 3: If a court of competent jurisdiction finds any section, paragraph, clause,
phrase, or part of this ordinance invalid, such decision shall not affect the validity of the remaining
provisions of this ordinance, and the application of said provisions to any person or circumstances
shall not be affected thereby.
SECTION 4: All ordinances or parts of ordinances of the City of Johnson, Arkansas, in
conflict herewith are specifically repealed, only to the extent of the conflict.
SECTIONS: All provisions of said Ordinances No. 99-6 not hereby amended shall remain
in full force and effect.
SECTION 6: The City Council hereby determines that the above amendments are necessary
to correct errors, facilitate the proper enforcement of the Zoning Ordinance and to provide for orderly
development of areas of the City; and that amendment of these regulations is essential to protect the
health, safety, and welfare of the public; and that the immediate passage of this ordinance is necessary
to adequately accomplish these purposes. Therefore, an emergency is hereby declared to exist and
this ordinance being necessary for the public welfare shall be in full force and effect from and after
its passage and approval.
