Ordinance 2002-08

AN ORDINANCE ANNEXING TO THE CITY OF JOHNSON
PARCEL OF LAND IDENTIFIED IN "DECREE OF ANNEXATION
4-15-2002 BY HONORABLE JERRY HUNTON IN CASE NO.CC-2002-5 IN THE
COUNTY COURT OF WASHINGTON COUNTY, ARKANSAS, AND FOR
OTHER PURPOSES.
WHEREAS, John H. Tyson, Clear Creek, LLC, and the Walters Trust are the majority
owners (collectively 61.03%) of a certain described parcel of real property which lies adjacent to the
City of Johnson, Arkansas, and is described as follows, to-wit:

WHEREAS, John H. Tyson, Clear Creek, LLC, and the Walters Trust have requested that
the above described parcel of real property be annexed to the City of Johnson, Arkansas.
WHEREAS, the University of Arkansas is the beneficial owner of the other 38.97% of the
above described real property and does not oppose nor object to the annexation of the above
described parcel into the City of Johnson. Washington County, Arkansas.
WHEREAS, John H. Tyson, Clear Creek, LLC, and the Walters Trust, prosecuted an action
before the County Court of Washington Count}', Arkansas, securing aDecree of Annexation on April
15, 2002.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JOHNSON,
ARKANSAS,
SECTION I: That the parcel of real property described at Exhibit A hereto and situate in
BmunicipaltaJJ Property Anntv Ordinance
Washington County. Arkansas, is hereby accepted as an annexation of the City of Johnson, Arkansas.
SECTION 2: It is hereby determined that the annexed parcel of real property is contiguous
and adjacent to other lands in Johnson, Arkansas, which are located in Ward . and therefore the
above described parcel is determined and declared to be in Ward of the City of Johnson.
SECTION 3: The official Zoning Districts map of the City of Johnson, Arkansas, is hereby
amended to show the annexation to the City of the parcel of real property described at Exhibit A as
a part of Ward 3 and such property is hereby zoned A-1
