ORDINANCE NO. 2003-17
AN ORDINANCE TO AMEND THE ZONING DISTRlCT CLASSIFICATION
AND BOUNDARlES REGARDING PROPERTY IDENTIFIED IN REZONING
PETITION NO. 2003-26, AND DECLARlNG AN EMERGENCY TO EXIST
WHEREAS, the Planning Commission has passed Rezoning Petition No. 2003-26 and
recommended to the City Council passage of an ordinance to rezone the described propetiy from A-1
to C-1;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JOHNSON,
ARKANSAS:
SECTION 1: That the zone classification of the following described property be changed
:fromA-1 to C-1:
A part of the East Half (E 12) of the Northwest Quarter (NW Y.) of Section Twentytwo
(22) in Township Seventeen (17) North, Range Thirty (30) West, being more
particularly described as follows, to wit:
From the Northeast Comer of a certain Fie (5) acre tract, conveyed by the J. H.
Peerson to W.A. and J.A. Skillern as described in deed recorded in Record Book 91
at page 280; thence S 00° 44' 43" W,- 291.12 feetto the POINT OF BEGINNING;
thence continue southerly along said line, a distance of380.97 feet; thence N 85° 30'
22" W,- 159.97 feet; thence N 77° 23' 17" W,- I 0.00 feet to a curve to the right, of
which the radius point liesN !6° 49' 12" E, a radial distance of533.57 feet; thence
westerly along the arc, through a central angle of00° 21' 32", a distance of3.34 feet;
thence N no 49' 17'' W, - 93.14 feet to a point of curve to the right having a radius
of30.00 feet and a central angel of91 ° 49' 46"; thence northwesterly along the arc
a distance of 48.08 feet; thence N 19° 00' 3 0" E, 63.01 feet to a point of curve to the
right having a radius of 370.00 feet and a central angle of 57° 47' 42"; thence
northeasterly along the arc a distance of3 73.22 feet to the POINT OF BEGThlNING,
and containing 1.77 acres, more or less, and subject to any easements anciJor rightsof-
way, of record, and restrictions, if any.
SECTION 2: That the official Zoning District's map of the City of Jolmson, Arkansas is
hereby amended to reflect the zoning change in Section 1 above.

SECTION 3: BE IT FURTHER ORDAINED BY THE CITY COUNCIL'FOR THE CITY
OF JOHNSON, THAT after considering the impact and value development of the above described
property will have on that particular area ofJohnson and the City as a whole, the Council determined
that the peace, welfare and safety of the citizens will be improved and therefore an emergency is
hereby declared to exist, this ordinance shall be immediately effective upon its passage and approval.
