ORDINANCE NO. 2004-5
AN ORDINANCE REVISING THE FEES CHARGED FOR
BUILDING PERMITS AND ESTABLISHING A PLAN REVIEW
FEE FOR CERTAIN PROPOSED CONSTRUCTION WITHIN THE
CITY OF JOHNSON, ARKANSAS, REPEALING A PORTION OF
SECTION 2 OF ORDINANCE NO. 40, DECLARING AN
EMERGENCY TO EXIST AND FOR OTHER PURPOSES
WHEREAS, the fees charged by the City of Johnson relating to issuance of building permits
are in need of revision in order to keep up with costs to the City of providing sendees related thereto;
WHEREAS, the City has not heretofore had a standardized comprehensive fee schedule for
review of plans which the City ordinances require to be reviewed by the Building Official.
BE IT ORDAINED BY THE CITY COUNCIL OF JOHNSON, ARKANSAS:
Section 1: That the City of Johnson ordinances shall be amended so that, after passage
of this Ordinance the following indicated fees shall be applicable:
a) BUILDING PERMIT FEES: Building permit fees will be determined by the value
of the proposed building. The square footage of the proposed building will be determined by the
Building Inspector and the square footage then multiplied by $58.00, the resulting value will be used
to determine building permit fees according to attached fee schedule. When the cost exceeds
$224,500, (the last figure on the enclosed chart), the building permit fee will be increased by $3.00
for each $1,000.00 or part thereof, increase in cost.
b) PLAN" REVIEW FEES: When the valuation of the proposed construction exceeds
$1,000.00, plans consisting of drawings, specifications, computations and additional data shall be
submitted to the City. A plan review fee shall be paid to the City of Johnson at the time of submitting
plans and specifications for checking. Said fee is in addition to the building permit fee and is non-

refundable. The plan review fee shall be assessed by the following scale based on the value of the
improA'ements to be constructed and/or the type of construction:
A. For Single family residences:
3500 square feet and less the plan review fee shall be $25.00;
for 3501 square feet and above, the plan review fee shall be $50.00;
B. For all other buildings:
$ 1,000 - $50,000 - one half permit fee (minimum $50.00)
$50,001 -$100,000 = $130 plus $1.30 per $1,000 or fraction thereof in excess of $50,001.
$100,0014500,000-$195 plus $.70 per $1,000 of fraction thereof in excess of $100,001.
$500,001 - $5,000,000 - $475 plus $.35 per $1,000 or fraction thereof in excess of $500,001.
$5,000,001and more - $2,050 plus $.175 per $1,000 of fraction thereof in excess of $5,000,001.
Section 2: That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby amended to the extent of such conflict.
Section 3: That S ection 2 of Ordinance No. 40 requires that the Chief Building Inspector
for the City be a resident of Johnson ( among other things); that residency requirement is hereby
repealed while the remainder of Section 2 and the remainder of Ordinance No. 40 are hereby ratified
and confirmed.
Section 4: Recognizing the fact that the current process of the City for collecting building
permit fees has no basis in our ordinances, and the need to specify fees to be charged for plan reviews
by the building inspector/official, there exists an immediate need to provide certainty in both these
areas for the benefit of current residence, developers and visitors to the City, the council hereby
declares that an emergency exists and therefore this ordinance, necessary for the orderly operation
of city government which contribute to the health, safety and welfare of it's citizens shall be
immediately effective upon its passage and approval.
