ORDINANCE NO. 2005-11
AN ORDINANCE TO AMEND THE ZONING DISTRICT
CLASSIFICATION AND BOUNDARIES REGARDING
PROPERTY IDENTIFIED IN REZONINGPETITIONNO. 2004-29
AND DECLARING AN EMERGENCY TO EXIST.
WHEREAS, the Planning Commission has passed Rezoning Petition No. 2004-29 and
recommended to the City Council passage of an ordinance to rezone the described property from R-3
toC-1;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JOHNSON,
ARKANSAS:
SECTION I: That the zone classification of the following described property be changed
from R-3 to C-l:
Part of the S Yz of the SE 1A of Section 16, Township 17 North, Range 30 West,
Washington County, Arkansas, being more particularly described as follows:
Commencing at the SE corner of the SE % of the SE V* of Section 16:
Thence coincident with the Southern line of said Section 16, North 87° 43' 04" West
for a distance of 1138.15 feet to a found stone;
Thence continuing along said Southern line, North 87° 01' 33" West for a distance
of 510.76 feet to a found stone, said stone being also the TRUE POINT OF
BEGINNING of the hereinafter described tract;
Thence continuing along said Southern line, North 87° 23' 27" West for a distance
of 25.60 feet to the Eastern Right-of-Way line of Interstate 1-540;
Thence coincident with said Eastern Right-of-Way line, North 20° 54' 54" West for
a distance of 352.23 feet to a point;
Thence continuing along said Eastern Right-of-Way line, North 20° 49' 18" Westfor
a distance of 152.31 feet to a point;
Thence leaving said Eastern Right-of-Way line, South 87" 13' 22" East for a distance
of 225.56 feet to a found s/s" rebar;
Thence South 02° 14' 41" West for a distance of 258.53 feet to a point;
Thence South 02° 44' 09" West for a distance of 203.52 feet to the POINT OF
BEGINNING and containing 58,299 square feet or 1.34 acres, more or less.
Subject to any and all existing easements,, covenants, restrictions or rights-of-way of
record or prescription.

SECTION 2: That the official Zoning District's map of the City of Johnson, Arkansas is
hereby amended to reflect the zoning change in Section 1 above.
SECTION 3: After considering the impact and value development of the above described
property will have on that particular area of Johnson and the City as a whole, the Council hereby
detenninflsthat the peace, welfare and safety of the citizens will be improved and therefore an
emergency is hereby declared to exist, this ordinance shall be immediately effective upon its passage
and approval.
