ORDINANCE NO. 2005-13
AN ORDINANCE REPEALING ORDINANCES NO* 2004- 19
AND NO. 2004-20 OF THE CITY OF JOHNSON, AR AND
DECLARING AN EMERGENCY TO EXIST
WHEREAS, THE Johnson City Council passed Ordinance No. 2004-19 on December 20,
2004.
WHEREAS, the Johnson City Council passed Ordinance No. 2004-20 on December 20,
2004.
WHEREAS, both Ordinances had to do with the Clear Creek Redevelopment District #1 .
WHEREAS, since the passage of these ordinances considerable debate, concern and
question have arisen concerning TIP Districts culminating in legislation and at least one lawsuit.
WHEREAS, no bonds have been issued and no taxes have been received involving the
Clear Creek Redevelopment District #1 as of this time.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF JOHNSON,
ARKANSAS, THAT:
Section 1: Ordinance No. 2004-] 9 of the City of Johnson is hereby repealed in its
entirety.
Section 2: Ordinance No. 2004-20 of the City of Johnson is hereby repealed in its
entirety.
Section 3: In order to avoid harm or damage to any resident or citizen of Johnson and
in order to avoid expensive and protracted legal wranglmgs over TIP Districts, it is necessary that
this Ordinance take effect immediately. Therefore, in order to preserve and protect the health,
safety and welfare of the citizens of Johnson an emergency is hereby declared to exist and this

Ordinance shall become effective immediately upon its passage and approval.
