ORDINANCE No. 2006-04
AN ORDINANCE AMENDING THE PERSONNEL POLICY OF THE
CITY OF JOHNSON, ARKANSAS, APPLICABLE TO ALL
EMPLOYEES BY ESTABLISHMENT OF AND PROMULGATING
RULES FOR A SICK LEAVE BANK; AND DECLARING AN
EMERGENCY TO EXIST;
"WHEREAS, the City of Johnson has a personnel policy in effect which applies to all
employees:
WHEREAS, the Johnson Police Department at Section 61 of its Policy Manual, addresses
the issue of sick leave for police officers and comports with Arkansas law;
WHEREAS, the Johnson City Council has determined that one of the City's greatest assets
is its representatives in all departments who interact with City residents and visitors;
WHEREAS, current personnel policies, as mentioned above, provide for a maximum
amount of sick leave/ sick days which may be accumulated.
WHEREAS, the City Council is aware that in certain extraordinary circumstances the
current sick leave/sick day policies are inadequate and may force the cessation of sendee to
the City by an employee whom the City would prefer to retain.
BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF JOHNSON,
ARKANSAS, that,
Section 1: The Personnel Policy of the City of Johnson and its enabling legislation along
with the Policy Manual of this Johnson Police Department are hereby amended to include the
following Sick Leave Bank.
Section 2: Sick Leave Bank
a) Participation At the beginning of each calendar year, (within 25 days
of the final reading of the ordinance adopting this policy) all employees who
have full benefits must declare whether they intend to participate in the Sick
Leave Bank by January 15 (or 15 days after the date of employment, in the
case of an employee hired during the year). Each employee electing to
participate in the Sick Leave Bank must contribute at least one-half day of
accumulated sick leave to the Bank(as soon as earned in the case of new
hires). Such declaration and contribution shall be made on a Sick Leave
Bank Form distributed and collected by the Mayor's office.
If during the course of a calendar year, the Sick Leave Bank runs out of
contributed days, the Mayor will notify employees of this occurrence and
will request the immediate completion of another Sick Leave Bank Form.

An employee's failure to contribute at least another one-half day of
accumulated sick leave (as soon as earned in the case of new hires) will
terminate that employee's participation in the Sick Leave Bank until the next
opportunity to contribute arises.
b) Governance A three member committee shall oversee the administration
of the Sick Leave Bank. The committee shall be comprised of the Mayor,
the Recorder/Treasurer, and one full-time employee elected in an election
run by the Police Chief. The committee shall decide on requests based on
the committee's rules of operation. Requests for leave from the Sick Leave
Bank should be routed to the Mayor and Chairperson of the Sick Leave
Bank Committee.
c) Rules of Operation
1) Only those employees who have made contribution to the Bank during the
most recent contribution period may make requests for grants from the bank.
2) Sick Leave Bank days will be granted only in cases of physical, mental, or
emotional illness of the employee or illness or death in the immediate
family. Immediate family shall include the employee's spouse, children,
parents, and any other relatives living in the same household.
3) The Sick Leave Bank days may be used only upon exhaustion of member's
accumulated sick leave. Days used from the Sick Leave Bank are grants
and do not require repayments. Therefore, the committee expects
employees to use discretion in making requests for days from the Sick
Leave Bank. Before approving a request for Sick Leave Bank days, the Sick
Leave Bank committee may review sick leave records and/or require
appropriate documentation. (May include doctor's or psychologist's
statement verifying disability and/or expected duration).
4) Request for Sick Leave Bank days will be made on a Sick Leave Bank
request form submitted to the chairperson of the Sick Leave Bank
Committee and the Mayor. Request forms may be obtained from the
Mayor.
5) Sick Leave Bank days will not be granted if an applicant is eligible for or is
receiving income from an income protection insurance policy or similar
coverage.
6) Sick leave grants made from the Sick Leave Bank shall be for no more than
sixty days for an individual applicant per application. Any unused sick
leave bank days granted may not carry forward to any subsequent year and
shall be returned to the Sick Leave Bank if unused at the end of a calendar
year.
7) Unused days contributed to the Sick Leave Bank will accumulate and carry
forward (in total — not by individual).
Section 3: All ordinances, parts of ordinances, or portions of the existing sick leave/sick
day policy of the City and/or the Policy Manual of the Johnson Police Department in conflict
with Section 2 hereof are hereby expressly repealed to the extent of such conflict.
Section 4: It is recognized that there are currently two valuable City employees who may
be forced to take undesirable employment action if this ordinance does not go into effect
before the next Council meeting. Therefore, in order to continue to preserve the health,
safety and welfare of City residents an emergency is hereby declared and this ordinance shall
be immediately effective upon its passage and approval.
