ORDINANCE NO. 2006-10
AN ORDINANCE ACCEPTING THE FINAL EASEMENT
DEDICATION PLAT FOR TRACT A OF CLEAR CREEK
APARTMENTS, PHASE II, IN THE CITY OF JOHNSON,
ARKANSAS; AND DECLARING AN EMERGENCY TO EXIST
THAT WHEREAS, there has been duly presented to the City Planning Commission of
Johnson, Arkansas, the Final Easement Dedication Plat for Tract A of Clear Creek Apartments,
Phase II in the City of Johnson, Washington County, Arkansas, being more particularly
described as follows, to-wit:
See Exhibit A hereto
AND WHEREAS, said Planning commission has approved the Final Easement
Dedication Plat for Tract A of Clear Creek Apartments, Phase II presented by Petitioner which
has been approved by the Springdale Water and Sewer Commission and the Planning
Commission has approved the dedication of the water and sanitary sewer easements and water
easements shown upon said final plat and joins with the said Petitioner in petitioning the City
Council to accept the Final Easement Dedication Plat for Tract A of Clear Creek Apartments,
Phase II.
AND WHEREAS, a hearing was held upon the acceptance of said final plat by the city
Planning Commission and such final plat was accepted and has been recommended to the City
Council.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JOHNSON, ARKANSAS: '

SECTION 1 : That the Final Easement Dedication Plat for Tract A of Clear Creek
Apartments, Phase II, as shown on the final plat approved by the City Planning Commission, a
copy of which is attached to this Ordinance and made a part hereof as though set out herein word
for word, be and the same is hereby accepted by the City of Johnson, Washington County,
Arkansas, and the City hereby accepts for the use and benefit to the public, the dedications
contained therein of the water and sanitary sewer easements and water easements.
SECTION 2: That the continued progress of the development of this area is of vital
interest to the City and affects numerous citizens and some delay has already been caused by the
City. Immediate passage, approval and effectiveness of this Ordinance is necessary for the
public peace, health and safety. Therefore an emergency is hereby found to exist and is hereby
declared. This ordinance shall be in full force and effect from the day of its passage and
approval.
THIS ORDINANCE PASSED THIS 12th day of December, 2006.
