ORDINANCE NO. 2007-03
AN ORDINANCE ESTABLISHING REQUIREMENTS FOR
REIMBURSEMENT OF ENGINEERING FEES AND COSTS AFTER
REVIEW OF DEVELOPMENT PLANS IN THE CITY OF
JOHNSON, ARKANSAS
WHEREAS, the City Council of the City of Johnson to insure proper engineering,
development and construction of all real property within the incorporated boundaries of
the City of Johnson, and
WHEREAS, development plans and drainage calculations are required for all
commercial and industrial developments; lot splits, multi-family and residential
developments: all site improvements to real property zoned residential, commercial or
industrial; and additions to existing structures on real property zoned commercial and
industrial, when the improvements or additions to existing structures exceed the
requirement for a large scale development submittal, and
WHEREAS, the cost associated with providing adequate and competent review of
these development plans by professional engineers has increased dramatically, and
WHEREAS, it was determined that this Ordinance is necessary to increase the
amount of fees charged to property owners and/or developers to offset the cost being
borne by Johnson taxpayers for engineering fees to review plans and calculations for
proposed developments.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JOHNSON, ARKANSAS:
Section 1: That along with the submission of a Subdivision Preliminary Plat, to
the Johnson Planning Commission, owners and/or developers shall complete an
application provided by the City, provide all documents requested, and remit a nonrefundable
review fee of $2.000. in the event engineering review fees and costs incurred
by the City of Johnson exceed $2,000, owners and/or developers shall reimburse the City
of Johnson for all additional expenses incurred. The required fees must be paid before tbe
Mayor will sign the Final Plat. This fee is in addition to the standard submittal fees that
the City has established.
Section 2: That along with the submission of a Large Scale Development plan,
owners and/or developers shall complete an application provided by the City, provide all
documents requested, and remit a non-refundable review fee of $500. Jn the event
engineering review fees and costs exceed $500. the owners and/or developers shall
reimburse the City of Johnson for all additional expenses incurred. The required fees
must be paid before the City will issue a Certificate of Occupancy for the first building
the is part of the project. This fee is in addition to the standard submittal fees that the City
has established.
Section 3: Repealing Clause. All other ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Severability Clause, hi the event any part of this Ordinance is
declared inoperative or invalid as a result of a statute or judicial decision, then only that
portion expressly so declared to be inoperative or invalid shall be affected thereby and all
other provisions hereof shall remain in full force and effect.
SectionS: Emergency Clause. That the City Council of the City of Johnson,
Arkansas further determines that this Ordinance is necessary to offset the cost being borne
by Johnson citizens in engineering expenses; therefore an emergency is hereby declared to
exist and this Ordinance shall be in full force and effect from and after its passage and
approval.
