Ordinance 2008-05

AN ORDINANCE APPROVING AND ADOPTING A PROJECT PLAN
PURSUANT TO ARK. CODE ANN. §§ 14-168-301 ET SEQ.,
SPECIFICALLY INCLUDING WITHOUT LIMITATION ARK. CODE
ANN. § 14-168-306 FOR THE CITY OF JOHNSON REDEVELOPMENT
DISTRICT NO. 1 - THE STEPS AT JOYCE MIXED USE PROJECT;
ADOPTING A PLAN TO INCLUDE TAX INCREMENT FINANCING IN

SUCH PROJECT PLAN; DECLARING AN EMERGENCY; AND OTHER RELATED MATTERS.

WHEREAS, pursuant to Ordinance No. 2007-20 dated January 8, 2008, the City
of Johnson, Arkansas (the "City") approved the creation of a redevelopment district
named the "City of Johnson Redevelopment District No. 1 -The Steps at Joyce Mixed
Use Project" (the "District"), designated the boundaries of the District, and established a
special fund for the revenue and expenditures generated on account of the District; and
WHEREAS, a project plan (the "Project Plan") has been created for the District
pursuant to Ark. Code Ann. § 14-168-306 and has been presented to the City for its
approval; and
WHEREAS, the City held a public hearing on February 12, 2008, at which all
interested parties desiring to be heard in connection with the Project Plan were afforded
a reasonable opportunity to express their views on the approval of the Project Pian(the
"Hearing"), and
WHEREAS, notice of the Hearing was published in the Northwest Arkansas
Times, a newspaper of general circulation in the City on January 28, 2008, which was
more than fifteen (15) days prior to the Hearing, and
WHEREAS, prior to the publication of such notice, copies of the notice were sent
by first-class certified mail to the chief executive officer of all local governmental and
taxing entities having the power to levy taxes on property located within the proposed
redevelopment district and to the superintendent of any school district which includes
property located within the proposed redevelopment district, such persons being
Washington County Judge Jerry Hunton, Johnson Mayor Lonnie Barron, Fayetteville
School District Superintendent Dr. Bobby New, and Springdale School District
 Superintendent Dr. Jim D. Rollins; and

WHEREAS, the City desires to approve and adopt the Project Plan as presented
at this meeting.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF JOHNSON, ARKANSAS:
Section 1. The Project Plan, including a plan for tax increment financing,
attached hereto as Exhibit A is hereby approved and adopted as the project plan for
the District pursuant to Ark. Code Ann. § 14-168-306.
Section 2. Pursuant to Ark. Code Ann. § 14-168-306, the City hereby finds the
Project Plan is economically feasible based on the information and data contained in the
Project Plan.
Section 3. In the event any portion of this Ordinance is declared or adjudged to
be invalid or unconstitutional, such declaration or adjudication shall not affect the
remaining portions of this Ordinance, which shall remain in full force and effect as if the
portion so declared or adjudged invalid or unconstitutional were not originally a part of
this Ordinance.
Section 4. All ordinances and resolutions, and parts thereof, which are in
conflict with any provision of this Ordinance are hereby repealed to the extent of such
conflict.
Section 5. EMERGENCY. It is hereby ascertained and declared that there is
an immediate need for the City to approve and adopt the Project Plan for the District for
the purpose of eliminating and preventing the development and spread of slums or
blighted, deteriorated and deteriorating areas, and discouraging the loss of commerce,
industry and employment, and increasing employment within the City. It is, therefore,
declared that an emergency exists, and this Ordinance, being necessary for the
immediate preservation of public health, safety and welfare, shall be in full force and
take effect immediately from and after its passage.
