Ordinance 2013-05

AN ORDINANCE REPEALING ORDINANCE NO. 46 OF THE TOWN OF JOHNSON WHICH ORDINANCE REQUIRED A CITY WIDE ELECTION TO CONVEY OR TRANSFER AN INTEREST IN REAL PROPERTY AND FOR OTHER PURPOSES

 

WHEREAS, Ordinance No. 46 which was adopted September 5, 1978, required a city wide election to approve the sale, mortgage, conveyance, encumbrance or other disposition of any ownership interest in any tract or parcel of real estate or real property owned by said Town.


WHEREAS, such a procedure in 1978 might have been inconvenient, in today's economy and business climate it is not only burdensome and time consuming but it is very costly and unnecessary.

 

BE IT ORDAINED BY THE CITY COUNCIL OF JOHNSON, ARKANSAS, That:

 

Section 1: Ordinance No. 46 which required a vote of the citizens before conveyance or transfer of an interest in real estate is hereby repealed.


Section 2: That from and after the effective date of this Ordinance a majority vote of the City Council is required to authorize specified officials or employees of the City to convey, transfer, sell, mortgage, pledge, encumber or otherwise dispose of any interest in real property.
