Ordinance 2013-07

AN ORDINANCE AUTHORIZING THE COLLECTION OF WARRANT SERVICE FEES BY THE JOHNSON POLICE DEPARTMENT REPEALING ORDINANCE NO. 2002-10 AND FOR OTHER PURPOSES


WHEREAS, that the City Council of the City of Johnson, Arkansas, is aware that additional costs are incurred by the City as a result of the Johnson Police Department servering warrants.


WHEREAS, Arkansas law allows Police Departments to charge the same fee for service of warrants as Sheriffs are authorized to collect, it is prudent to continue enabling legislation to authorize the Johnson Police Department to collect a fee for the service of warrants as so authorized.


NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JOHNSON, ARKANSAS:


Section 1: Warrant Service Fees: For each warrant issue by the Johnson Department of the Springdale District Courts served on a Defendant appearing before said Court, there shall be collected from each such Defendant upon each plea of guilty, nolo contendere, forfeiture of bond or determination of guilt for misdemeanors or traffic violations in said Court the sum of Fifty Dollars ($50.00).


Section 2: Disposition of Fees Collected: From and after the effective date of this Ordinance, the fees collected by the Court for the issuance and service of warrants shall be deposited in the General Fund


Section3: Warrant Service Fund: That all funds in the Warrant Service Fund as of the 10th day of May 2013, shall be transferred into the General Fund
