ORDINANCE NO .. 2014-01
AN ORDINANCE ESTABLISHING POLICY FOR USE OF THE
PEDESTRIAN/BIKE TRAILS WITHIN THE CITY OF JOHNSON AND
PROVIDING FOR A PENALTY FOR VIOLATION OF SUCH POLICY
AND AMENDING THE JOHNSON MUNICIPAL CODE BY ADDING
CHAPTER 12.01 AND CHANGING THE NAME OF TITLE 12
WHEREAS, a portion of the Razorback Greenway Trail system lies within the City of
Johnson;
WHEREAS, additional trails within the City are contemplated and being planned to
connect with and supplement the Razorback Greenway Trail;
WHEREAS, a policy for use of the public pedestrian/bike trail within. Johnson will help
ensure safety and utility of the trail; and,
WHEREAS, the Johnson Police Department shall have primary responsibility for
enforcement of the trail policy within the city and is authorized to issue warnings and/or citations for violation of such policy.
BE IT ORDAINED BY THE CITY COUNCIL OF JOHNSON, ARKANSAS, That:
Section 1: That the Johnson Municipal Code is hereby amended as follows:
a) The title of chapter 12 is hereby amended to read, "Title 12 Trails, Parks and.
Recreation'.'; and,
b) Under Title 12, Trails, Parks and Recreation, Chapter 12.01 Johnson Trail Policy
is hereby added as follows:

12.01.01 Application
The policies set forth in this Chapter shall apply to all public Pedestrian/Bike Trails within the City of Johnson as shown on the map reflected at Section 12.01.02. Notice of the Johnson Trail Policy shall be posted at all official access points to the public trails and near the City limits where a trail within the city connects to a trail within another jurisdiction; such. Notice shall be on permanent material and either state the Johnson Trail Policy in full or by summary of significant points and, in either case, shall state that full text versions of the Policy may be viewed online and at City Hall

12.01.05 Rules of Road for Pedestrian/Bike Trails Within Johnson, Arkansas
a) Pedestrians, skaters and joggers. Pedestrians, skaters and joggers should walk, skate
or jog near the right side of the trail to accommodate faster runners, skaters,
bicyclists, and faster traffic to pass on the left side of the lane."
b) Bicyclists. skaters, runners and. others. Persons should ride their bicycles, segways,
skateboards and scooters on the right side of the lane unless passing. Persons skating,
riding bicycles, segways, skateboards, scooters and runners shall give an audible
warning prior to passing slower traffic. Passers shall not cross the solid yellow line.
Passers shall not cross the dashed yellow line if oncoming traffic is close enough that
the passer cannot return to his/her lane before reaching oncoming traffic or if crossing
the dashed yellow line causes any safety hazard."
c) Speed limit.
1) No person shall skate or ride his bicycle, segway, skateboard, scooter or other
vehicle on a city trail at a speed greater than is reasonable and prudent under the
conditions then existing.
2) No person shall skate or ride his bicycle, segway, skateboard, scooter or other
vehicle at a speed greater than 15 m.p.h. on a city traiL
3) No person shall skate or ride his bicycle, segway, skateboard, scooter or other
vehicle at a speed greater than 10 m.p.h. on a city trail when oncoming traffic is
present or when passing traffic going the same direction.
4) Persons skating or riding bicycles, segways, skateboards, scooters, or other
vehicles on a city trail in such a manner as to indicate a reckless disregard for the
safety of others shall not only be subject to punishment set forth in 12.01.15 but
may have their privilege to skate or ride their vehicle upon the city trails
suspended for up to one year. Any person violating a suspension period shall be
guilty of a separate violation of this subsection and punished accordingly.
12.01.06-09 Reserved.
12.01.10 Vehicle Use Restricted on Trail.
a) No golf carts or comparable sized vehicles nor any gas powered vehicles (except city
maintenance or emergency vehicles) shall be driven or operated on any city trail.
b) Skates, skateboards, and electrically powered scooters, wheelchairs, bicycles,
segways, etc. may be used on city trails only when their use does not create a safety
hazard for pedestrians, wheelchairs or human powered bicycles.
12.01.11-14 Reserved.
12.01.15 Penalty.
a) Whoever violates any provision of 12.01.05 c) 4) shall, upon conviction thereof be·
guilty of a misdemeanor and fined as set forth at JMC Sec. 1.32.01 in addition to any
suspension of their privilege to skate or ride their vehicle on city trails.
b) Any person who violates any other provision of this Chapter shall, upon conviction
thereof, be guilty of a violation, and shall be fined not less than $10.00 nor more than
100.00."

PASSED AND APPROVED on this 11th day of March 2014.
