ORDINANCE NO. 2015-12   

AN ORDINANCE REPEALING ORDINANCE NO. 2013-10,

AMENDING THE ZONING DISTRICT CLASSIFICATION AND BOUNDARIES REGARDING

THE REAL PROPERTY IDENTIFIED IN REZONING PETITION NO. 2013-05

OF WALTER ROBINSON APPROVED AUGUST 26, 2013 BY THE

JOHNSON PLANNING COMMISSION AND DECLARING AN EMERGENCY TO EXIST.

 

 

WHEREAS, the Planning Commission on August 26, 2013 , passed Rezoning Petition No. 2013-05 of Walter Robinson and recommended to the City Council passage of an ordinance to rezone the described property from A-1 to C-2.

WHEREAS, an ordinance document was prepared for the consideration, decision and approval of the City Council on the matter of rezoning the land described in Rezoning Petition 2013-05.

WHEREAS, the City Council was clear on the parcel of real property described in the rezoning petition and was not under any mistake of fact as the intent of their decision and vote on the rezoning.

WHEREAS, as a result of inadvertence or clerical misprision the legal description of a parcel of land owned by the City was attached to Ordinance No. 2013-10 as Exhibit A when the Ordinance was signed by the Mayor and Recorder-Treasurer , posted in the public places "within the City and filed with the Circuit Clerk and Recorder.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JOHNSON, ARKANSAS, That:

Section 1:        That Ordinance 2013-10 should be and hereby is repealed effective with the passage of this ordinance.

Section 2:        That the zone classification of the following described property be changed from A-1 to C- 2:

See attached "Exhibit A"

Section 3:        That the official Zoning District" s map of the City of Johnson, Arkansas is hereby amended to reflect the zoning change in Section 1 above.

Section 4:         In order to correct an error. To avoid any further injury or harm to an owner of property within the City and to promote the health, safety and welfare of residents and citizens of this City an emergency is hereby declared and this Ordinance shall be effective immediately upon its passage and approval.
