ORDINANCE NO. 2016 -01

AN ORDINANCE CREATING DUTY OF REAL PROPERTY OWNERS, OCCUPANTS AND OTHERS IN THE CITY TO PROHIBIT OBSTRUCTING, OBSCURING OR HIDING OF FIRE HYDRANTS ON THEIR PROPERTY OR IN THE CITY, CREATING A PENALTY FOR VIOLATION OF SUCH DUTY AND FOR OTHER PURPOSES

 

WHEREAS, protection of city residents and the public from the danger of fires and related circumstances is high on the list of the City's obligations;

WHEREAS, support of the local volunteer fire department is critical to the City of Johnson fulfilling that obligation;

WHEREAS, preparation, training, and equipping a fire department are all essential steps in carrying out the function of fighting and suppression of fires, those steps are of limited value without the provision of available fire hydrants to connect to the firefighting apparatus;

WHEREAS, appropriately located and supplied fire hydrants must be easily located and available for speedy connection by fire department personnel to maximize the effect of fighting fires;

WHEREAS, property owners and occupants occasionally allow trees,plants,brush,tall weeds/grass, fences, walls, decorations or other items to block access to or hide from viewthose firehydrants;

WHEREAS , fire hydrants are periodically tested and may be painted/marked in order to alert and notify fire department personnel of available pressure; and

WHEREAS, it is incumbent upon all owners and occupants of property to assist the efforts of the City and members of the Johnson Area Volunteer Fire Department by taking actions to provide a clear area around, and to do nothing to inhibit fire department personnel from making connections to a fire hydrant.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JOHNSON, ARKANSAS:

SECTION 1: General Description.

It is the intent of this section to enable firefighters to quickly locate and access fire hydrants for the purposes of testing, training, and fire suppression. The provisions herein established are designed to accomplish this by keeping the perimeter around fire hydrants free of visible and physical obstructions.

SECTION 2: Standards.


  1. It shall be a violation and unlawful for Owners or occupants of real property within the City , Arkansas, , to allow any such fire hydrant to become obstructed/hidden by trees, brush, shrubs, weeds, grass in excess of two (2) inches,flowers,fences,decorations,walls or other items or structures of any type by keeping the area around hydrants cleared within three feet (3') in all directions of such hydrants.
    1. It shall be a violation and unlawful for any person to obstruct or hide a fire hydrant by any means  within the City of Johnson.
    2. It shall be a violation and unlawful for any person to paint,mark or otherwise cover, camouflage or obscure fire hydrants except duly authorized City or utility personnel.

SECTION 3: Enforcement.

  1. Failure to comply with the provisions set forth in this section shall be a violation punishable by a fine of no less than $25.00,but not to exceed$150.00 for a first offense,plus any applicable court costs.

SECTION 4: Effective Date.

This ordinance shall become effective as of April 1, 2016.
