ORDINANCE NO. 2016-14

AN ORDINANCE AMENDING ORDINANCE NO. 2007-08
(JOHNSON'S LARGE SCALE DEVELOPMENT
ORDINANCE) AND FOR OTHER PURPOSES

 

WHEREAS, development of real property in Northwest Arkansas and the City has seen many changes over the last eight years;

WHEREAS, the City staff and Planning Commission are constantly revisiting procedures set out in City ordinances to keep them consistent with similar provisions in sister cities;

WHEREAS, the City staff and the Planning Commission recommend certain amendments to the Large Scale Development Ordinance to protect the unique character of our City and yet
facilitate healthy new development.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF JOHNSON,
ARKANSAS, That:

Section 1:                      That 'Section 2: Applicability' of Ordinance No. 2007-08 is hereby

amended to read as follows:

"Section 2: Applicability

This ordinance establishes minimum design standards, providing minimum improvements to be made or guaranteed to be made by the developer, establishing overlay districts for certain highway corridors, establishing interstate signage districts for certain highway
corridors, setting forth the procedure to be followed by the Planning Commission in applying these rules, regulations and standards and prescribing penalties for the violation.

A Large Scale Development will be required for all projects on one acre or more which meets one of the following.

  1. All new construction of commercial buildings in zones C-1, C-2, C-3, R-O, PUD, or I.
  2. All additions to existing commercial buildings where the addition is greater than or equal to 5,000 square feet in zones C-1, C-2, C-3, R-O, PUD or I.
  3. All new construction or additions to multi-family housing, if the new construction or addition exceeds 5 units in zones R-M.
  4. All changes from residential use to any other use classification of a building, without consideration of the zoning district at that location.
  5. All new construction or additions to existing buildings in the A-I zone where the final building square footage exceeds 5,000 square feet.
  6. All placement of nonresidential trailers.
  7. All parking lots over 5 spaces in size.A. through G. above shall not apply to a PUD zoning district which contains an
    Approved Regulated Plan (as defined in Ord. No. 2007-10 as amended)."

Section 2:   Section 3: Development Plan Approval Procedure of Ordinance 2007-08 is amended by deleting the first paragraph beginning with "Before" and ending with "factors.", such paragraph is deleted in its entirety.

Section 3:   These amendments to Ordinance 2007-08 shall be effective on the date of passage and approval of this Ordinance.

Section 4:   That in all other respects Ordinance 2007-08 is approved, confirmed and ratified.
