ORDINANCE NO. 2016-18

CITY OF JOHNSON, WASHINGTON COUNTY, ARKANSAS AN ORDINANCE AMENDING SECTION 7.12.04 PLACES OF CHAPTER 7.12: POSTING OF ORDINANCES OF THE JOHNSON MUNICIPAL CODE SPECIFYING THE FIVE (5) PLACES FOR POSTING OF ORDINANCES AND OTHER NOTICES, AND DECLARING AN EMERGENCY

     WHEREAS, the City Council of Johnson has adopted Section 7.12.04 PLACES, of Chapter 7.12: POSTING OF ORDINANCES et seq., as amended; and

     WHEREAS, on or about December 13, 2011, the City Council of Johnson adopted Ordinance No. 2011-11 providing five (5) specific places for posting of ordinances and other notices within the city and said Ordinance No. 2011-11, as it has been amended and was thereafter codified within Chapter 7.12: POSTING OF ORDINANCES in the Johnson Municipal Code; and

   WHEREAS, the City Council of the City of Johnson now finds it to be in the best interest of the citizens of the City of Johnson to amend Section 7.12.04 PLACES OF Chapter 7.12 POSTING OF ORDINANCES of the Johnson Municipal Code; and

   WHEREAS, having fully reviewed the proposed amendment, the Johnson City Council has determined that Section 7.12.04 PLACES of Chapter 7.12: POSTING OF ORDINANCES, of the Johnson Municipal Code should be revised and amended, as set forth herein  below.

           NOW THEREFORE, BE IT ENACTED AND ORDAINED, by the City Council of the City of Johnson, as follows:

Section 1.  Section 7.12.04 PLACES of Chapter 7.12: POSTING OF ORDINANCES, of the Johnson Municipal Code shall now read as follows:

7.12.04 Places Effective with the passage of this ordinance, the five (5) most public places in Johnson, Arkansas, are hereby determined to be:

                 City Hall -  south entrance;

                 City Hall - 2904 Main Drive, freestanding bulletin board; Police Department, 2904 Main Drive, inside bulletin board;

                 Former Post Office, southwest corner of Main and Wilkerson, freestanding bulletin board; and

                 Shoppes at the Mill, 3801 Greathouse Springs Road, freestanding bulletin board
             

Ordinance Amending Section 7I 2.04 of Chapter 7I 2 Posting of Ordinances.
In the event that any section,  paragraph,  subdivision,  clause,  phrase, or other provision or portion of this Ordinance shall be adjudged invalid or unconstitutional, the same shall not affect the validity of this Ordinance as a whole, or any part or provision, other than the part so decided to be invalid or unconstitutional, and the remaining provisions of this Ordinance shall be construed as if such invalid, unenforceable or unconstitutional provision or provisions had never been contained herein.


Section 3.        Declaration of Emergency.   It is hereby found and determined that Section7.12.04Chapter 7.12: POSTING OF ORDINANCES, of the Johnson Municipal Code should be immediately amended in order to clarify and amend the five (5) specific places for posting ordinances and other notices within the City of Johnson. Therefore, an emergency is declared to exist, and this act, being immediately necessary for the preservation and protection of the public peace, health, safety and welfare of the City and its citizens, shall become effective on the date of its passage and approval by the Mayor.
