ORDINANCE NO. 2016-19

 CITY OF JOHNSON, WASHINGTON COUNTY, ARKANSAS 

AN ORDINANCE TO REPEAL ORDINANCE NO. 2016-16 IN ITS ENTIRETY, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.

WHEREAS, Ordinance No. 2016-16 was adopted by the City of Johnson City Council on July 12, 2016;

WHEREAS, Ordinance No. 2016-16 purported to amend Ordinance No, 2007-09, an ordinance which sets for the rules and regulations for the installation of signs within the City of Johnson, specifically pertaining to billboard and digital billboard signs in the City of Johnson;

WHEREAS, Ordinance No. 2016-16 was passed without an emergency clause and therefore is set to go into effect on or about September 10, 2016, sixty (60) days, pursuant to Arkansas law, from its adoption pursuant to Act 1093 of 2015 and Ark. Code Ann. § 14-55-203(c)(1)(A); and

WHEREAS, regardless of the effective date of Ordinance No. 2016-16, the City Council of the City of Johnson, after due consideration, believes that it is in the best interest of the citizens of the City of Johnson to repeal Ordinance No. 2016-16 in its entirety.

NOW THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF JOHNSON, ARKANSAS:

SECTION 1.  Ordinance No. 2016-16 is hereby repealed in its entirety.

SECTION 2.  Ordinance No. 2007-09, as amended by Ordinances 2011-12 and 2012-02, is hereby reinstated in full and shall and does remain in full force and effect as if not amended by Ordinance No. 2016-16.

SECTION 3.  If any section, subsection, sentence, clause, phrase, or portion of this Ordinance if for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distant and independent provision and such holdings shall not affect the validity of the remaining portions thereof.

EMERGENCY CLAUSE.  The City Council hereby determines that this Ordinance is necessary to preserve the quiet enjoyment of property, the character of the of the city, the safety of motorists who travel on streets and highways through the city and the harmony of land uses in and around the City of Johnson. Therefore, an emergency is declared to exist, and this Ordinance being immediately necessary for the preservation and protection of the public peace, health, safety and welfare of the City and its citizens, shall become effective immediately upon its passage and approval.
