AN ORDINANCE ESTABLISHING 1HE OFFICE OF TOWN MARSHALL, DEFINING THE DUTIES OF SAID MARSHALL, AND FIXING THE COMPENSATION THEREFOR.
BE  IT ORDAINED BY THE TOWN COUNCIL OF THE INCORPORATED TOWN OF JOHNSON, WASHINGTON COUNTY, ARKANSAS


Section 1. That whereas, Municipal Corporations have the power to make and publish from time to time By-Laws and Ordinances not inconsistent with the Laws of this State as to the Municipality, necessary to provide for the safety, to preserve the health, promote the prosperity and improve the morals, order, comfort and convenience of such corporation and the inhabitants thereof, and such further Ordinances as shall be necessary to secure such corporation and its inhabitants against injury by fire, thieves, robbers, burglars, and other persons violating the public peace; and whereas, in regular meeting duly assembled the Town Council of the Incorporated Town of Johnson, Arkansas, has made the considered decision that it is necessary, proper and for the best interest of the sam Town that the office of Town Marshall be established.


Section 2: Therefore, the office of Town Marshall is hereby estabiished pursuant to the applicabl.e laws of Arkansas:

 

(a) That the duties of the said Town Marshall shall be those prescribed by the Laws of Arkansas, the same being Act of March 9, 1875, No. One, Section 46, and Acts amendatory thereto;

 

(b) That his power to make arrests, suppress all riots and distubances and breaches of peace, to apprehend all disorderly persons in the Town; to pursue and arrest any person fleeing from justice in any part of the State; on the Tuesday following the first Monday in November; and whereas, said election date has passed, it will be necessary to appoint some person to perform the duties of Town Marshall until the next election.

 

Section 4: That the .person appointed or elected Town Marshall shall execute an oath of office and bond with surety for the faithful discharge of his duties.

 

Section 5: That the compensation to be received by the said Marshall shall be a salary of $0 per month; and the fees provided by law.

 

Section 6: That due to the situation as it presently exists, ln the Incorporated Town of Johnson, Washington County, Arkansas, it is necessary for the peace, health and safety of the citizens of Johnson that this Ordinance be enacted and an emergency is hereby declared to exist, and this Ordinance shall take effect and be in full-force and effect from and after its passage.
