AN ORDINANCE TO AMEND ORDINANCE NUMBER 117, THE

INTERIM ZONING ORDINANCE FOR THE TOWN OF JOHNSON,
ARKANSAS.

WHEREAS, The Interim Zoning Ordinance was passed by the Town
Council of Johnson, Arkansas on 12 October , 1993; and
WHEREAS, The Town Planning Commission has made a
comprehensive study of the Interim Zoning Ordinance; and
WHEREAS, The Town Planning Commission has recommended
changes in the Interim Zoning Ordinance to allow a more orderly
and suitable development of land within the Town of Johnson.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
JOHNSON, ARKANSAS:

 

Section One - Changes in Johnson, Arkansas Interim Zoning
Ordinance.
a. Change the cover heading to read: JOHNSON, ARKANSAS
ZONING ORDINANCE"
b. Page i - Under Table of Contents, delete the word,
"Interim" .
c. Page ii - #XI Mobil Homes, delete #2 and #4.
d. Page 1 - Delete the word, "Interim" from heading and
throughout pages 1 and 11.
Section Two - Districts
a. Page 15 - Under 5): Change "rental park settings" to
"mobile home parks". Delete "or in subdivisions which provide
for ownership of structure and lot."
Section Three - Permitted uses by District Table
a. Page 17 - Remove singes family mobile home from A-l
District.
b . Remove mobile home subdivisions .
c. Page 18 - Move all zoning regulations one space to the
right. (Corrected on some copies)
Section Four — Yard and Area Requirements
a. Page 19 - Remove single M.H. from A-l.
b . Remove R— 4 M.H. subdivision . Place R-4 one
line down.
c. Remove single M.H.
d. Change bottom line of page with asterisk to
read "Lot Area Size is for sewer, sizes shall
be 1 acre for septic tanks .

Section Five - Special Provisions
a. Page 28 - 2. Agriculture
Change "B" to the following:

No poultry houses, hog pens, hog houses or commercial
domesticated animal pens, barns or feed lots in the A-l zoning
district shall be allowed closer than 300 feet from any zoning
district, including an adjoining A-l zoning district, in the city
limits of Johnson.

 

Section Six - Mobile Homes
a. Page 30 - Section XI Mobile Homes
Remove the words, "Mobile Home Subdivision" throughout
#1.
b. Mobile Home General
1. Insert "B": Mobile homes are permitted in mobile
home parks located in districts zoned R-4 and
shall not be placed in any other location in the
City of Johnson.
2. Insert "C": Any mobile home in a nonconforming
zoning district prior to the effective date of
adoption of this ordinance shall be accepted until
its use is discontinued or abandoned for six (6)
consecutive months. It shall not thereafter be
allowed in a nonconforming zone.
3. Change heading letters as follows: B to D; C to
E; D to F; E to G; F to H; delete present G; H to
I; I to J; J to K; K to L.

4. Under I - Delete the words, "The one time permit
for a mobile home or manufactured home and". Then
delete the words, "of the "mobile home or
manufactured home or removal".
5. Page 31 - Delete all of Section 2. Mobile Home
Subdivision.
6. Change 3. Mobile Home Park to 2. Mobile Home
Park.
7. "A" - Delete the last two words, "this section"
and add "The City of Johnson Subdivision
Regulations."
8. Delete sections B, C, D, and E.
9. Delete all #4, Mobile Home Park/Subdivision
approval procedure A, B, and C.

Section Seven - A copy of the "Johnson/ Arkansas Zoning
""Ordinance" with, all the above noted changes is attached to this
ordinance as Exhibit "A". Three copies of the new "Johnson,
Arkansas Zoning Ordinance" will be on file for public viewing
during business hours at City Hall, Johnson, Arkansas.
Section Eight - Severability
a. If any paragraph, sentence or clause of this ordinance
shall be declared invalid by a court of competent jurisdiction,
such determination of invalidity shall not affect the remaining
portion of this ordinance.
Section Nine - Repeal of Conflicting Ordinances
a. All ordinances or parts of ordinances of the Town of
Johnson in conflict with this ordinance are hereby rescinded.
Section Ten - Effective Date
a. It has been found and is hereby declared by the Town
Council of the Town of Johnson, Arkansas, in regular session
assembled, that this ordinance is immediately required in order
to lessen congestion in the streets; to secure safety from fire
and other dangers to promote healthful living conditions; to
provide adequate light and air; to prevent the over-crowding of
land and undue concentration of population; to stabilize property
values and to insure the orderly development of the community for
the general welfare of the citizens.
b. Therefore, an emergency is hereby declared to exist and
this ordinance being necessary for the preservation of the public
peace, health, and safety shall be in full force and effect from
the date of its approval.
