AN ORDINANCE ENTITLED "AN ORDINANCE PRESCRIBING
TRUCK ROUTES AND REGULATING TRUCK AND VEHICULAR
TRAFFIC IN THE CITY OF JOHNSON, ARKANSAS".
WHEREAS, there exists in the City of Johnson, Arkansas, a
number of one-way bridges and
WHEREAS/ such bridges were not designed and/or constructed
to accommodate with safety the large heavily loaded trucks and
vehicular traffic currently using such one-way and inadequate
bridges, and
WHEREAS, the City Council of the City of Johnson finds that
the continued use of such one-way and inadeguate bridge spans by
truck and vehicular traffic constitutes a present and continuing
danger to operators of such truck traffic and vehicles and to the
population of the City of Johnson generally, and
WHEREAS, the City Council of the City of Johnson has
determined after many public hearings that unregulated truck
traffic on residential streets in the City of Johnson is not safe
for the residents of those streets and is causing damage to the
residential streets, and
WHEREAS, the City Council of the City of Johnson finds that
truck routes should be established routing heavy vehicular
traffic around such one-way' and inadequate bridges and streets

for the safety of the operators of heavy truck and vehicular
traffic and residents of the City of Johnson generally/ and to
regulate and prohibit the use of non-designated truck and heavy
vehicular traffic to all other residential streets in the City of
Johnson;
NOW/ THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JOHNSON AS FOLLOWS:
SECTION ONE: That Hewitt Street/ McGuire Street and Ball
Street be, and said streets are hereby designated as the North-
South truck route in the City of Johnson; that Main Street East
and West from the East corporate limits West to the Rail Road
right-of-way and Van Asche Street from Gregg Street to McGuire
Street is hereby designated as the East-West truck route in the
City of Johnson.
SECTION TWO: That the City of Johnson shall erect signs
giving notice that no person shall drive, nor move, nor cause to
be driven or moved as through traffic a vehicle or vehicles of a
size or weight exceeding Ten Thousand (10/000) pounds gross over
or upon the public residential streets situate in the City of
Johnson, Arkansas/ except those streets designated as truck
routes in Section One of this Ordinance/ provided however, that
the provisions of this Ordinance shall not apply to fire or
police vehicles or apparatus.
SECTION THREE: Any person/ individual, firm or corporation
violating the terms of this Ordinance shall be fined in a sum not
less than $25.00 nor more than $100.00/ and each day's violation
shall be and constitute a separate offense.
SECTION FOUR: This Ordinance is declared to be severable
and if any section, clause, sentence or phrase shall be declared
to be unconstitutional, such unconstitutional section, clause,
sentence or phrase shall not affect the remaining sections,
clauses , sentences or phrases of this Ordinance .
SECTION FIVE: It has been found and hereby declared by the
City Council of the City of Johnson, Arkansas in regular session
assembled, that this Ordinance is immediately reguired for the
preservation of the public health, safety and general welfare.
Therefore, an emergency is hereby declared to exist.
SECTION SIX: This Ordinance shall be in effect from and
after its approval , passage , publication and the recording of a
certified copy thereof with the recorder of Washington County,
Arkansas .
