AN ORDINANCE TO AMEND ORDINANCE NO. 162
TO REFLECT THE CORRECT LEGAL DESCRIPTION
FOR THE PROPERTY DESCRIBED IN ORDINANCE
NO. 162, AND ALSO PROPERTY IDENTIFIED IN THE
CITY OF JOHNSON ZONING PETITION NO. 95-12.
WHEREAS, the legal description described in Ordinance Number 162 was
inaccurate and the City, at this time, has been provided with the correct legal description of
said property and
WHEREAS, the correct legal description is vitally needed to file the proper plat
with the Office of the Circuit Clerk of Washington County.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF JOHNSON,
ARKANSAS:
SECTION 1: That the zoned classification of the following described property
changed from Residential 2 to Residential 3.
Legal Description: A part of the Northwest Quarter (NW 1/4) of the
Northeast Quarter (NE 1/4) and part of the Southwest Quarter (SW 1/4) of the Northeast
Quarter (NE 1/4) of Section 22. Township 17 North. Range 30 West being more
particularly described as follows:
Commencing at the Northeast corner of said NW 1/4 NE 1/4, thence South along the East
line of said NW 1/4 NE 1/4 869.50 feet to the Southerly right-of-way of the St. Louis &
San Francisco Railroad (now the Arkansas & Missouri Railroad): thence along said rightof-
way South 59 5 48 West 671.68 feet to the Point of Beginning (P.O.B.); thence
South 30 59 14 East 144.99 feet; thence South 7 49 39 West 71.62 feet; thence North
82 T1 West 37.88 feet; thence North 76 57 27 West 255.41 feet to a point on the
Southerly right-of-way of the St. Louis & San Francisco Railroad; thence along said rightof-
way North 59 5 48 East 258.11 feet to the Point of Beginning, containing .68 acres,
more or less, and also being known as Lot 1, proposed Bodenstein Subdivision to the City
of Johnson, Washington County, Arkansas. This property is subject to the Right of Way
of Hewitt Street along the South side thereof.
This amended Ordinance is necessary in that the original Ordinance, Number 162
contained errors in the original legal description.
SECTION 2: That the official zoning districts map of the City of Johnson,
Arkansas is hereby amended to reflect the zoning change in Section 1 above. s
SECTION 3: That the official zoning petition be amended to reflect (he qorrected
legal description as noted above.

SECTION 4: EMERGENCY CLAUSE The City Council determines that an
emergency exists and this Ordinance, being necessary; for the preservation of the health,
safety, and welfare of the citizens of Johnson , Arkansas shall be effective immediately
upon its passage, approval, publication, and recording of a certified copy thereof with
Recorder of the Washington County, Arkansas.
