ORDINANCE NO.26
AN ORDINANCE ENTITLED, 11 AN ORDINANCE TO REGULATE
THE MOVING OF BUILDINGS ON, THROUGH, OVER OR
ACROSS THE PUBLIC STREETS, ALLEYS, SIDEWALKS OR
OTHER PUBLIC PLACES IN THE TOWN OF JOHNSON,
ARKANSAS, AND FOR OTHER PURPOSES. 11
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF JOHNSON, ARKANSAS.
SECTION 1. That hereafter no person, firm or corporation shall move any
building on, through or over any street, alley, sidewalk or other
public place in the Town of Johnson, Arkansas, without having obtained
a permit therefor from the Chief Inspector. Application for
such permit shall be in writing and directed to the Town Clerk and
shall state thereon the name and address of the applicant, the point
from which the proposed move will commence, the proposed tract or
tracts of land upon which said building will be located, the assessed
valuation of the building, type of construction of said building, that
the structure has been approved by the Chief Inspector, proposed route
and the number of days it is in tended that the building shall occupy
any portion of any street, alley, sidewalk or other public place.
SECTION 2. Upon approval of the intended route by the Chief Inspector, a
fee of Fifteen Dollars ($15.00) for each day or fraction thereof that
the building or structure shall occupy any such portion of any street,
alley, sidewalk or other public place, shall be paid to the Chief
Inspector and the permit issued. An additional payment of Fifteen
Dollars ($15.00} for each day or fraction thereof over and above the
time stated on the permit which any building shall occupy, such street,

SECTION 3. As a condition to the granting of such a permit, every person,
firm or corporation applying for a permit under this Ordinance shall

SECTION 4. Whenever a street or alley is blocked by a house or structure
which is being moved, warning to that effect shall be placed by the
Town Marshall so as to warn vehicles and persons from entering that
portion of the street or alley so blocked. The person, firm or corporation
moving any building through the streets at night shall keep
warning signs and amber lanterns or lights on the building or structure
so as to guard against any person or vehicle colliding with said
building or s true ture.
SECTION 5. Whenever it shall be necessary to interfere with wires or cables
of a public utility in moving a building, the terms of any special or
franchise Ordinance governing it shall apply andcthe bond therein
specified shall be given in addition to the bond to insure the protection
of the Town against damages. If no such terms apply then the
Chief Inspector shall determine the expense of repairing the wires
and_the bond to be given to cover such expense.
SECTION 6. Any person, firm or corporation violating any of the provisions
of this Ordinance shall be fined no less thancTwenty-Five Dollars
($25.00) and no more than One Hundred Dollars ($100.00) for each
offense, and a separate offense shall be deemed committed on each day
or portion of day during on or which a violation occurs or continues.
SECTION 7. Each section of this Ordinance shall be considered as a separate
section and the unconstitutionality of any one section of this Ordinance
shall not invalidate the remaining sections of this Ordinance.
WHEREAS, it is necessary for the immediate preservation of the public
health, peace and safety, an emergency is hereby declared to exist and this
Ordinance shall be in full force and effect from and after its passage,
approval and publication.
