AN ORDINANCE ENTITLED "AN ORDINANCE AMENDING ORDINANCE
NO. 23, THE SAME BEING THE ZONING ORDINANCE OF
THE CITY OF JOHNSON,. ARKANSAS, AND THE PLAT PERTAINING
THERETO, AND FOR OTHER PURPOSES."

WHEREAS, Diven Hendrix and Margie B. Hendrix, his wife, have
filed their petition praying that the hereinafter described lands be
rezoned from Re?idential A to Commercial Zone and,
WHEREAS, the Planning Commission of the City of Johnson,
Arkansas, after advertising the date, time and place of the hearing
concerning the matter of·re.d istricting the hereinafter described tract·
of real estate from Residential A to Commercial Zone:

 

Part of the Southeast quarter (SEl;r) of the Northv1est quarter
(NWl:r) of Section T'"enty three (23) in Township Seventeen (17)
North of Range Thirty (30) West, described as follows, to-wit:
Beginning at the Southeast corner of said 40 acre tract and
running thence North 518.24 feet, thence South 86 degrees
West 125 feet, thence North 50 feet for a point of beginning
of the lands herein intended to be rezoned, thence North 200
feet, thence Sou·th 86 degrees West 361.95 feet, thence South
. 200 feet, thence North 86 degrees East 361.95 feet to the
point of beginning, said property being further described as
being 361.95 feet East and West and 200 feet North and So"u·th
and laying on the South side of Main Street and immediately
West with Midway Transmission Service in the Town of Johnson,
Washington County, Arkansas.

AND WHEREAS, after notice for the time and in the manner required
by lav1 the Planning Commission of the City of Johnson held a hearing
and after hearing arguements for such rezoning and the Planning Commission
of the City of Johnson feeling that the area described should be redistricted
and changed from Residential A to Commercial Zone in that the
purpose of the zoning ordinance would be more properly carried out by
such redistricting and that unless granted the citizens of Johnson would
suffer irreparable harm and damage, and would be substantially deprived
of the use of their property.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the City of
Johnson, Arkansas:

 

SECTION 1: Ordinance No. 23 , the Amendments thereto,
and the Zoning Plat pertaininq thereto of the City of Johnson,

inning, said property being further described as being 361.95
feet East and West and 200 feet North and South and laying
on the South side of Hain Street and immediately West with
Midway Transmission Service in the Town of Johnson, Washington
County, Arkansas.

SECTION 2: If any word, sentence, phrase, paragraph or section
of this ordinance shall be declared unconstitutional, said
word, sentence, phrase, paragraph or section shall not effect
remaining portions of this ordinance.
SECTION 3: This ordinance shall be in full force and effect
from and after its-passage, approval and publication and the
recording of certified copy thereof in the office of the ciicuit
Clerk and Ex-Officio Recorder of Washington County.
