AN ORDINANCE RELATIVE TO THE OFFICE OF CITY
ATTORNEY, DEFINING THE DUTIES OF SAID CITY
ATTORNEY, AND PROVIDING FOR COMPENSATION FOR
SAID OFFICE.

BE IT ORDAINED BY  THE CITY COUNCIL OF THE CITY OF
JOHNSON, WASHINGTON COUNTY, ARKANSAS:

That whereas, the office of city attorney for cities of

the second class is provided for under the applicable laws of the
State of Arkansas, the duties of the said City Attorney shall be
as follows:

That the duties of the city attorney shall be those
prescribed by the laws of Arkansas which include that said city
attorney shall present the city in all actions, both civil and,
criminal and shall receive as part of his compensation the same
fees as are provided prosecuting attorneys in this state in all

criminal cases;

 

Provided that the law further prov.ides the city by proper
ordinance may specify certain salary or· salary and fees as· the
council may desire, and the law further provides that in the.
event the attorney is paid a salary only the city is authorized
to collect the fees above referred to and same to be applied as
the council may direct.

1. That as the law requires the attorney operating under

the provision of this statue shall be a regular licensed attorney

of this state, the attornery is expressly authorized to file

information for the arrest of any person for the violation of any

ordinance of said city or the laws of the State of Arkansas

3. That as teh statutes of the State of Arkansas provide

that the city attorney may receive as part of his compensation

the same fees as are allowed prosecuting attorneys in this state

of Arkansas provide that such fees are as follows:

For each judgment obtained on complaint, information, or
otherwise, in the name of the State or any County, $5.00.

 

For each conviction on indictment, presentment or information

for misdemeanors or breach of the peace, $10.00.

For each conviciton in case of gambling, $25.00.

 

They (prosecutipg attorneys) shall be allowed ten per

cent ( 10%) of the amount on forfeited bail bonds and recognizances
(Ark. Stat. 2-1707).

 

BE IT FURTHER. ORDAINED that. as the above referred to
statutes governing the compensation of City attorneys provides that
the City  Council may specify a certain salary or salaries and fees

as the Council may desire, that the Council of the City of Johnson,

Arkansas, hereby declares that all fees as·hereinabove set forth.
which may be collected and percentages of forfeited bail bonds

and recognizances shall be duly colleeted by the said City of

Johnson, Arkansas, and  that the compensation of the city attorney

for the City of Johnson shall be a salary of $50.00 per month

and in addition shall receive the fees paid to the City as prescribed

by law.

That the City Council of the City of Johnson, Arkansas,

further determine that this ordinance is nececcary to adequately

and properly protect the public peace, health, and safety of the

inhabitants of the said City, therefore, an emergency is hereby

declared to exist and this ordinance shall be in full force and
