AN ORDINANCE RELATIVE TO THE OFFICE OF CHIEF
OF POLICE, DEFINING THE DUTIES OF SAID CHIEF
OF POLICE. AND PROVIDING FOR COMPENSATION FO
SAID OFFICE.

IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JOHNSON, WAHINGTON COUNTY, ARKANSAS:

THAT whereas, the Office of Chief of Police. for cities
of the second class is provided for under the applicable laws of
the State of' Arkansas, narnely Arkansas Statute 19-1103. 2, and

the duties of the said Chief of Poiice, shall be as follows:

To execute and return all writs and process to him
directed by the Judge of said City Court, and in·criminal cases
or cases of a violation of the City Ordinance, he may serve the
same on any part of the County, it shall be his duties to
suppress all riots and disturbances and breeches of the peace,
tc apprehend all disorderly persons in the City and to pursue
and arrest any person fleeing from justice in any part of the
State; to apprehend any person in the act of committing any
offense against the laws of· the State, or Ordinances of the City,

and forthwith bring such person before the City Court Judge, or
other competent aauthority, for examination or trial; he shall
have the power to appoint one or mOre deputies, for whose
official acts he sha'll be responsiblei he shall, in the discharge
of his proper duties, have like powers, be subject to like
responsibilities, and shall receive like fees as sheriffs and,
constables in similiar cases. Arkansas Stat. Anno. 19-11 04;
that the law further provides that the city council of any city
of the second class, if they deem it to be in the best interest
of the City, and upon passage of an ordinance by majority of the
City Council, may proVide t·hat said chief of police shall be
appointed by the Mayor with the approval of the City Council.

1. That the City Council of the City of Johnson,
\Vushington County, Arkansas, does hereby approve the appointment
by the Hayor of Charles M. Clapp, for the office of Chief of
Police for Johnson, Arkansas, for a period beginning December
08, 1976, and tq extend for a one year period. The salary
to be paid to said chief of police shall be the sum of $150.00
per month to be paid for the f'irst ninety (90)  day period, and
the sum of $200.00 per month thereafter during said year. By
vote of a majority of the City Council, the Chief of Police can
be removed at any time during said one year or thereafter.
During the calendar year 1977, said chief of police shall be
alloted a two week paid vacation and may also have a two week
leave of absence for military service, without pay, and said
two week leave for military service shall not be credited against
said individual toward his two week paid vacation.

BE IT FURTHER ORDAINED that the City of Johnson shall
obtain a liability insurance policy on the Chief of Police
private vehicle to insure against liability while said vehicle
is being used for said city purposes and the City shall also
equip said private vehicle owned by the Chief of Police with the
proper radio and lighting equipment.

That the City Council of the City of Johnson, Arkansas,
further determines that this ordinance fs necessary to adequately
and properly protect the public peace, health and safety of the
inhabitants of tbe said City, therefore, an ernergency is hereby
declared to exist and this ordinance shall be in full force and
effect from and after its passage and publication.
