AN ORDINANCE REGULATING AND ESTABLISHING PROCEDURES
FOR THE EXPENDITURE OF PUBLIC FUNDS

 

WHEREAS, the Town of Johnson has not heretofore established procedures
for the expenditure of public funds, nor has determined upon what authorizations
such expenditures, contracts for expenditure, and other commitments
for spending public money may be undertaken; and

WHEREAS, it is of extreme importance that such procedures and authorizations
be established in order that city· officials may know the extent of·
their authority, and persons who deal with city officials will be aware of
such authorities;

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
JOHNSON, ARKANSAS, that:

SECTION 1: Without the prior authorization and consent
of the Tcwn Council of the Town of Johnson, Arkansas, _no

expenditure of town funds nor contract or commitment for
same shall be made by any public official.

SECTION 2: Authorization and consent of the Town Council
shall mean approval, by resolution or otherwise, by
majority vote of the whole Council at any regular or
special meeting thereof. Such authorization and consent
may be in the form of authorizing continuing contracts
for telephone, utility or other continuing services of
like nature for which the cost may not be determinable in
advance; or, by specific and special itemized approval.

SECTION 3: Expenditure shall include disbursement by cash,
check, or exchange of property or services. Contract or
commitment shall include any agreement, direct or indirect,
by which the To..m of Johnson becomes legally obligated to
pay or render to another something of value.

SECTION 4: All expenditures or disbursements of public
funds shall be by check, signed by the Mayor and Recorder,
or any other member of the Town Council especially author-

ized-by majortiy vote of the whole Council to substitute
because of the absence of the Mayor and/or Recorder from
the Town of Johnson.
SECTION 5: Noncompliance with this ordinance by any City
official, officer or employee shall constitute nonfeasance

It is hereby found that serious confusion exists as to what authority
public officers have with regard to expenditure of public funds and there.
is aprehension both on the part of public officials and those who deal·
financially with the Town of Johnson by which management of the Town's
fiscal affairs is immediately jeopardized. An emergency is therefore declared
existing and this ordinance, being essential to the preservation of
the public peace, health and safety of the Town of Johnson, shall take
effect immediately upon its passage and approval.
